- NATURE OF THE CASE
- 1. This is a putative class action on behalf of Robin Minor ("Plaintiff") and a
- class of all others similarly situated against Congoleum Corporation ("Defendant" or
- "Congoleum"), the manufacturer of DuraCeramic floor tiles used for commercial,
- industrial, institutional and residential flooring applications
- 2. Defendant's tiles are plagued by design flaws that result in chipping,
- flaking, cracking and scratching. Yet Defendant continues to sell them to the public and
- continues to make false representations and warranties, despite the fact that the tiles are
- defective and will eventually fail, costing consumers substantial removal and replacement
- costs.
- 3. This class action seeks damages, punitive damages, injunctive relief, costs,
- attorneys' fees, and other relief as a result of Defendant's willful, wanton, reckless,
- and/or grossly negligent conduct in causing consumers' homes to be in a defective and
- unfit condition for habitation.
