  3. I am e-mailing you today regarding two issues that have arisen with the administration of a loan by CENLAR FSB.
  4. Due to medical incapacity I became delinquent on my loan payments in June 2017. On 12 February 2018 Diane McCormick, Default Litigation Supervisor at CENLAR FSB, completed a complaint to foreclose mortgage against my loan. This complaint was acted upon further on 28 February 2018 by Sara Collins of McCalla Raymer Leibert Pierce, LLC - CENLAR FSB's attorney in the matter which led to it being filed in the Circuit Court of the Ninth Judicial Circuit of Florida in and for Orange County on 1 March 2018.

  6. It is, however, that prior to this, on 15 February 2018, that I contacted CENLAR FSB by telephone. During the telephone conversation I was informed that if I was able to make full payment of the delinquent amount. [insert dollar amount] that my loan would be considered current and no further action would be taken. In response to this information I made payment of $[insert dollar amount] via [insert payment method] which cleared with CENLAR FSB on 20 February 2018.

  8. On 21 February 2018 a notice was placed on my door recommending that I contact CENLAR FSB urgently. Upon contacting them I was informed that on 15 February CENLAR FSB had made misrepresentations and misled me and that I would need to contact McCalla Raymer Leibert Pierce, LLC in order to reinstate the loan. I immediately contacted McCalla Raymer Leibert Pierce, LLC and was informed I would be contacted with a reinstatement amount in the coming days.

  10. I was not given a reinstatement amount by McCalla Raymer Leibert Pierce, LLC until 28 February 2018 - the date on which they completed paperwork to file foreclosure against the mortgage. I immediately contacted CENLAR FSB regarding this and eventually through [INSERT NAME] it was arranged that due to the misrepresentation that CENLAR FSB had made to me on 15 February 2018 that I would make partial payment to CENLAR FSB and that CENLAR FSB would transfer this payment to McCalla Raymer Leibert Pierce, LLC in order for the loan to be reinstated. This process was completed on 5 March 2018, shortly following this the loan was reinstated.

  12. I have now, [insert date] received a statement requesting further 'attorney's fees' totaling [insert dollar amount].

I would like to point out at this stage that 15 February 2018 - the date at which I attempted to make full payment of the delinquent amount to CENLAR FSB and the date on which CENLAR FSB made misrepresentations to me and misled me is prior to 28 February 2018 the date on which documents were completed by McCalla Raymer Leibert Pierce, LLC which led to the filing of foreclosure.

  16. In addition 21 February 2018, the date on which I contacted McCalla Raymer Leibert Pierce, LLC requesting a reinstatement amount is prior to 28 February 2018 the date on which documents were completed by McCalla Raymer Leibert Pierce, LLC which led to the filing of foreclosure.

  18. I am, therefore, with all the above facts considered looking to ascertain the following.

  20. 1. Why, when I contacted CENLAR FSB on 15 February 2018, was action not stopped on my account?
  21. 2. Why, on 15 February 2018, did CENLAR FSB make misrepresentations towards me?
  22. 3. Why, when I contacted McCalla Raymer Leibert Pierce, LLC on 21 February 2018, was action not stopped on my account?
  23. 4. Why when I repeatedly contacted both CENLAR FSB and McCalla Raymer Leibert Pierce, LLC prior to 28 February 2018 fully paying the delinquent amount and attempting to pay any alleged fees was foreclosure filed against me on 28 February 2018?
  24. 5. What is the itemization of the 'attorney's fees' on the [insert date] statement?
