  15. \textbf{1.The Evaluation Process}
  16. \\After the proposals are opened and the vendors are identified, the selection
  17. committee is convened. Before the first committee meeting, the purchasing
  18. agent should prepare scoring forms. \\Evaluation must be based only on the
  19. criteria specified in the RFP. Other criteria cannot be added or substituted.
  20. All RFP responses are to be evaluated. \\Evaluators should not compare
  21. proposals against one another and should not include in the comments on one
  22. proposal any references to another offeror’s proposal. Proposals not meeting
  23. requirements should be scored lower. \\Evaluators should carefully document and
  24. justify their scores providing detailed, legible comments and specific references
  25. to an offeror’s responses, as this information is used during debriefing
  26. conferences with unsuccessful offerors.
  27. \\The selection committee should review and evaluate proposals as they affect
  28. committee members’ areas of interest and expertise. All findings should be
  29. shared among the committee members. \\During this step, the selection
  30. committee also may check references. The committee should check references
  31. other than those listed by the vendor.
  32. \textbf{2.The Scope of an Evaluation }
  33. \\The evaluation of proposals by the selection committee is limited to the criteria
  34. set forth in the RFP. At a minimum, the scope of the evaluation of each proposal
  35. should cover the following, so long as each of these is included in the published
  36. evaluation criteria: \\
  37. \textbf{•General quality and responsiveness:} Responsiveness to terms,
  38. conditions, and time of performance; completeness and thoroughness;
  39. understanding of the problem or of the work to be performed; and the
  40. proposed approach to be used.\\
  41. \textbf{• Organization and personnel:} Evidence of good organizational and
  42. management practices; qualifications of personnel; experience and past
  43. performance; financial condition; and, for goods and nonprofessional
  44. services, price and bid-price breakdown or price range and cost schedule.
  45. The selection committee must evaluate each proposal for satisfaction of all
  46. criteria set forth in the RFP.\\
  47. \textbf{3.Information Used to Evaluate Proposals}
  48. \\The selection committee should use the information contained in each proposal
  49. to evaluate its merit.
  50. \\For the evaluation of technical criteria, only the information contained in each
  51. proposal should be considered. However, the selection committee may request
  52. that a vendor provide additional technical information.
  53. \\
  54. \textbf{4.Evaluating Costs}
  55. \\An RFP for the procurement of goods or nonprofessional services may request
  56. that a prospective vendor include pricing information in its proposal. \\This pricing
  57. information should be treated as nonbinding, primarily because negotiations may
  58. bring to light additional needs or requirements not identified in the RFP or
  59. because some anticipated services may not be required.
  60. \\Nevertheless, if an RFP for the procurement of goods or nonprofessional
  61. services identifies cost as an evaluation criterion, it must be evaluated.
  62. Following are three different ways in which the cost of a procurement may be
  63. evaluated: \\
  64. This analysis consists of reviewing and evaluating separate
  65. cost elements and proposed profit of: (1) a vendor’s costs or pricing data;
  66. and (2) the judgmental factors applied in projecting from the data to the
  67. estimated costs, in order to form an opinion as to the degree to which the
  68. proposed costs represent what the contract should cost, assuming
  69. reasonable economy and efficiency.
  70. \\This analysis requires that the committee evaluate specific elements of cost, the necessity for certain
  71. costs, the reasonableness of the amounts estimated for the necessary
  72. costs, the reasonableness of allowances for contingencies, the basis used
  73. for allocation of indirect costs, the appropriateness of allocations of
  74. particular indirect costs to the proposed contract, and the reasonableness
  75. of the total cost or price.\\
  76. \textbf{• Price analysis:}
  77. \\ This analysis is made by examining and evaluating a
  78. proposed price without evaluating its separate cost elements and
  79. proposed profit.\\ In making this analysis, consideration must be given to
  80. any differing terms and conditions. Price analysis is used to determine if a
  81. price is reasonable and acceptable and involves an evaluation of the
  82. prices for the same or similar goods or services. \\This analysis requires the
  83. selection committee to evaluate the price submissions of prospective
  84. vendors in the current procurement, prior price quotations and contract
  85. prices charged, prices published in catalogues or price lists, prices
  86. available on the open market, and in-house estimates of cost.\\
  87. \textbf{• Value analysis:}
  88. \\This analysis evaluates the function of a product and its
  89. related costs in order to determine its inherent worth or value and to
  90. determine if the price is consistent with what the goods or services should
  91. cost. \\This analysis requires that the committee evaluate what the goods or
  92. services provide to the County, the life-cycle costs, whether there are
  93. other ways in which the service or function could be obtained and what it
  94. would cost, and whether there are features of the goods or services that
  95. could be modified or eliminated.
  96. \\The selection committee must determine how cost information will be evaluated
  97. before the evaluation process begins.
  98. \\
  99. \textbf{5.Determining Whether a Proposal is Suitable for Further Consideration}
  100. The selection committee may exclude a vendor from further consideration in the
  101. procurement process if it determines that its proposal is inferior based on scoring
  102. of the evaluation criteria and, therefore, not suitable for further consideration.
  103. \\The committee should not determine which proposals are not suitable on the
  104. basis of a predetermined cut-off score. Rather, those proposals determined to be
  105. excluded from further consideration should be those that are inferior because of
  106. deficiencies that are not easily correctable.
  107. \\A proposal must contain sufficient information so that the selection committee
  108. knows what is being proposed. An informational deficiency should be considered
  109. material, and the proposal inferior, only after the selection committee considers:
  110. \\(1) the detail called for in the RFP; \\(2) whether the omissions make the proposal unsuitable for further consideration or merely inferior; \\(3) the scope and range of
  111. the omissions; \\(4) whether the proposal offers significant cost savings; and \\(5)
  112. the number of off erors in the competitive range.
  113. Following are examples of deficiencies in a proposal that the selection committee
  114. may determine to be material and to render the proposal not suitable for further
  115. consideration:\\
  116. \textbf{• Fails to satisfy technical objectives:} \\The proposal is incapable of satisfying
  117. the technical objectives of the RFP.\\
  118. \textbf{• Material deficiencies:} \\The proposal contains deficiencies that are so
  119. material as to preclude any possibility of upgrading the proposal except
  120. through major modifications or revisions.\\
  121. \textbf{• Extremely low rating:} \\The proposal is rated so low that any attempt to
  122. upgrade the proposal to an acceptable level would require an
  123. unreasonable and unfair degree of assistance from the County.
  124.  
  125. \textbf{• Technical issue not clarified:} \\The proposal is technically inferior and the
  126. vendor fails to timely respond to a request for clarification.

  128. \textbf{• Price omissions:} \\The proposal omits a number of required prices.
  129.  
  130. \textbf{• Feasibility of approach unsupported:} \\The proposal fails to include detailed
  131. information establishing the feasibility of the vendor’s proposed approach.
  132.  
  133. \textbf{• Addendum not acknowledged:} \\The vendor fails to acknowledge receipt of
  134. an addendum to the RFP where offered prices would have been
  135. significantly increased by the addendum and vendors were advised that
  136. failure to acknowledge the amendment would result in rejection of the
  137. proposal.
  138. \\A vendor should not be excluded if there is a close question as to whether its
  139. proposal is competitive or if information deficiencies in the proposal can be
  140. corrected by information obtained during the negotiation process, particularly if
  141. the deficiencies are the result of deficiencies in the RFP. \\
  142. \textbf{6.Establishing a Short-list of Vendors}
  143. \\Upon completion of the evaluation of the proposals, the selection committee
  144. should assign a score based on evaluation criteria and classify each proposal
  145. either “acceptable for further consideration” or “not suitable for further
  146. consideration.” Thereafter, the committee shall invite two or more vendors it
  147. deems fully qualified, responsible and suitable, to interview with the committee.

  149. \\The County is not required to interview all vendors who submit proposals. The
  150. number of vendors selected depends in part on the size, scope and complexity
  151. of the project, the number of qualified proposals, and the time available to complete the selection process. \\The process becomes cumbersome when more
  152. than five vendors are considered at the interview stage.
  153. If the purchasing agent, on the recommendation of the selection committee,
  154. determines in writing and in his sole discretion that only one vendor is fully
  155. qualified, or that one vendor is clearly more highly qualified and suitable than the
  156. others under consideration, a contract may be negotiated and awarded to that
  157. vendor.
  158. \\Vendors whose proposals are eliminated from further consideration should be
  159. notified by the purchasing agent that their proposals were removed from further
  160. consideration. The notice should be in writing and advise the vendors of the
  161. decision and express appreciation for their participation in the process.
