Right now I'm with Inmotion Hosting. I'm with then since 2015 and I don't have any complaint about them. I don't know much about servers (I had a tech and he helped me with my website years ago, but now I'm alone) so I think I have this:

8GB RAM

260GB Storage

6TB Bandwidth
I guess (if someone can help me trying to figure out if that's details techs are true, that will be excellent).


The thing is that I have a website for translations. Just that, we translate TV shows from English to Spanish and that's it. We don't host any image, audio, video or any kind. We're just a community of translators and the users can download our translations and that's it.

Thing is that last week I received an email from the hosting saying that they received a DMCA notice from a company from Spain (representing FOX Espa?a) (FOX Spain) saying that they have the rights for The Walking Dead. Funny thing is that here on USA, FOX Espa?a doesn't even exists, that tv show is from AMC Network. So, the thing is that I contacted my hosting and told them that this company is from Spain, that they don't have jurisdiction in USA and that they already sent me some emails in the past (2016 and 2017) with the same thing about copyright and I dind't did anything because they don't have any jurisdiction in USA.

The different thing this time was that this company included my hosting on the email they sent to me about the copyright "material" and that's why they contacted me.

So, I'll be honest, if it were to me, I woud stay with Inmotion because right now I don't have my tech guy (who installed and fixed a lot of my VPS since 2015 and it's running perfect) but this company from Spain will be at my site just checking that we don't translate that show and if we do it again, I know they will send again the DMCA notice.

So, I'm looking for recommendations right now.

I was looking for offshore-servers dot com but after they checked my VPS, they told me that they can't migrate/clone my VPS because of my old versions:

CPanel and WHM 11.52.0 (build 17). I guess is: 11.74.0.10.

I have 24 hours translators on my site. So, I really need something that is up 99% time. Any recommendation? I won't post my site just for security. But if someone needs to watch my site, you can let me know.

Most providers do honor DMCA and some follow only their country's law so it depends but Europe is a good option.

You can use cloudlinux if you need lower php version. Just make sure you have the same mysql version though depending on your script.

DMCA notices contain all of the information required to process under EUCD - so typically European providers should also respect DMCA takedown notices (processed under EUCD).

User submitted subtitle translations is an interesting topic however. A Dutch court and a Swedish court have ruled that it does breach copyright, but logically that sounds stupid. If the copyright owner is concerned about fan subs, surely the real solution is to release their own translations with their media?

Based on this though, I think it is very likely it will fall afoul of EU copyright law across the whole of the EU, not just NL and SE.

I believe most Icelandic hosts won't follow DMCA orders. There are a few active on these forums, might be worth running a search and verifying with them directly

If you're in the country where the rights holder are, server location does not matter. They come after you, personally, not the site.

All countries, even ones falsely believed to be lawless (ie nonsense "offshore"), have IP laws in place.

That said, you'd think translating a show wold be seen as a good thing. I know I fully appreciate Japanese>English fansubbing. That company you're be hassled by is being a bit anal about "protecting". I actually have to wonder if translations are within the purview, really something they have rights to, or if this is one of those BS takedowns from casting an overly-wide net. You read about those a lot in recent years.
