  14. 본 라이선스 조건은 Microsoft Corporation (또는 거주 지역에 따라 계열사 중 하나)과 귀사 간에 체결되는 계약입니다. 본 사용권 계약을 읽어 주시기 바랍니다. 본 라이선스 조건은 위에 명시된 소프트웨어 및 이 소프트웨어가 포함된 미디어가 있는 경우 해당 미디어에 적용됩니다. 본 계약은 해당 품목에 별도의 약정이 있지 않는 한, 이 소프트웨어 및 온라인 서비스에 대한

  21. 본 라이선스 조건을 준수하는 경우 아래와 같은 영구적 권리를 행사할 수 있습니다.
  22. 1. 설치 및 사용 권한. Windows Server 2003, Windows Server 2008 및 Windows Server 2008 R2, Windows Server 2012, Windows XP, Windows Vista, Windows 7 또는 Windows 8 운영 체제 소프트웨어를 배포, 관리, 시스템 품질 평가, 시스템 및 장치 평가의 목적으로만 본 소프트웨어의 사본을 수량에 관계없이 귀하의 장치에 설치하여 사용할 수 있습니다.
  23. 2. 추가 사용권. 1항에 허여된 권한에 더하여, 본 소프트웨어의 특정 부분은2항에 명시된 대로 추가 사용권으로 제공됩니다. 이러한 추가 사용권은 2항 및 3항에 명시된 사용권 제한 사항을 준수한다는 조건으로 부여됩니다.
  24. a. Windows 사전 설치 환경. 귀하는 Windows 운영 체제 소프트웨어를 설치 및 복구할 목적으로 Windows 사전 설치 환경을 설치하여 사용할 수 있습니다. 일반 운영 체제, 씬 클라이언트 또는 원격 데스크톱 클라이언트로서(이에 국한되지 않음) 기타 다른 목적으로는 Windows 사전 설치 환경을 사용할 수 없습니다.

ImageX.exe, Wimgapi.dll, Wimmount.sys, Wimserv.exe, DISM.exe, DISMAPI.dll, Microsoft.Dism.Powershell.dll 및 Package Manager. 귀하는 Windows 운영 체제 소프트웨어를 복구하기 위해 소프트웨어의 ImageX.exe, Wimgapi.dll, Wimmount.sys, Wimserv.exe, DISM.exe, DISM.exe, Microsoft.Dism.Powershell.dll 및 Package Manager 부분을 설치하여 사용할 수 있습니다. 의심의 여지가 없도록, Windows 운영 체제를 백업할 목적을 포함하여(이에 국한되지 않음) 기타 다른 목적으로는 소프트웨어의 이러한 부분을 사용할 수 없습니다.

  31. • 샘플 코드. "샘플"로 표시된 코드를 소스 코드 및 개체 코드 형태로 수정, 복사 및 배포할 수 있습니다.

  33. ii. 배포 조건. 배포 가능 코드를 배포하려면

  39. • 귀하의 프로그램 배포 또는 사용과 관련된 모든 청구(변호사 비용 포함)로부터 Microsoft를 면책하고 해를 입히지 않으며 방어해야 합니다.
  40. iii. 배포 제한. 다음과 같은 행위는 허용되지 않습니다.
  41. • 배포 가능 코드의 저작권, 상표 또는 특허 표시를 변경하는 행위
  42. • Microsoft의 상표를 프로그램 이름에 사용하거나 귀하의 프로그램을 Microsoft에서 만들거나 보증한다고 광고하는 행위
  43. • 배포 가능 코드를 배포하여 Windows가 아닌 플랫폼에서 실행하는 행위

  57. • 소프트웨어를 임대, 대여 또는 대부하는 행위
  58. • 소프트웨어나 본 계약서를 제3자에게 양도하는 행위, 또는
  59. • 상업용 소프트웨어 호스팅 서비스에 소프트웨어를 사용하는 행위
  60. 9. 백업 사본. 귀하는 소프트웨어 백업 사본 하나를 만들 수 있습니다. 백업 사본은 소프트웨어를 다시 설치하는 경우에 한해 사용할 수 있습니다.
  61. 10. 문서화. 귀하의 컴퓨터 또는 내부 네트워크에 유효한 액세스 권한이 있는 사용자는 내부적인 참고 목적으로 설명서를 복사 및 사용할 수 있습니다.
  62. 11. 수출 제한. 소프트웨어는 미국 수출 법규 및 규정의 적용을 받습니다. 귀하는 소프트웨어에 적용되는 모든 국내 및 국제 수출법 및 규정을 준수해야 합니다. 이러한 법률에는 목적지, 최종 사용자 및 최종 용도에 대한 제한이 포함됩니다. 자세한 내용은 www.microsoft.com/exporting을 참조하십시오.

  65. 14. 관련 법률.
  66. a. 미국. 소프트웨어를 미국에서 구입한 경우, 국제사법 원칙에 관계없이 본 계약의 해석은 워싱턴 주법을 따르며 계약 위반에 대한 청구 발생 시에도 워싱턴 주법이 적용됩니다. 소비자 보호법, 불공정거래법 및 기타 불법 행위 관련 법규의 적용을 받는 청구가 발생한 경우 귀하가 거주하고 있는 주의 주법이 적용됩니다.
  67. b. 미국 외 지역. 본 라이선스 조건에는 대한민국 법이 적용됩니다.
  68. 15. 법적 효력. 본 계약은 특정 법적 권리에 대해 기술하고 있습니다. 귀하는 귀하가 거주하고 있는 국가의 법규가 보장하는 다른 권리를 보유할 수 있습니다. 또한 귀하가 소프트웨어를 구입한 당사자와 관련된 권리를 보유할 수도 있습니다. 귀하가 거주하고 있는 국가의 법에서 권리 변경을 허용하지 않는 경우 본 계약은 해당 권리를 변경하지 않습니다.

  80. These license terms are an agreement between Microsoft Corporation (or based on where you live, one of its affiliates) and you. Please read them. They apply to the software named above, which includes the media on which you received it, if any. The terms also apply to any Microsoft

  82. · supplements,
  83. · Internet-based services, and
  84. · support services
  85. for this software, unless other terms accompany those items. If so, those terms apply.
  86. By using the software, you accept these terms. If you do not accept them, do not use the software.
  87. If you comply with these license terms, you have the perpetual rights below.
  88. 1. INSTALLATION AND USE RIGHTS.
  89. a. Installation and Use. One user may install and use any number of copies of the software on your devices to design, develop and test your programs.
  90. b. Build Server List.  The software contains certain components that are identified in the Build Server List located at http://go.microsoft.com/fwlink/?LinkId=249022.   You may install copies of the files listed in it, onto your build machines, solely for the purpose of compiling, building, verifying and archiving your programs.  These components may only be used in order to create and configure build systems internal to your organization to support your internal build environment.  These components do not provide external distribution rights to any of the software or enable you to provide a build environment as a service to third parties. We may add additional files to this list from time to time.
  91. c. Included Microsoft Programs. The software contains other Microsoft programs. In some cases, those programs and the license terms that that apply to your use of them are addressed specifically in these license terms. For all other included Microsoft programs, these license terms govern your use.
  92. d. Third Party Programs. The software contains third party programs. These license terms as well as any license terms accompanying the third party program files apply to your use of them.
  93. 2. ADDITIONAL LICENSING REQUIREMENTS AND/OR USE RIGHTS.
  94. a. Distributable Code. The software contains code that you are permitted to distribute in programs you develop if you comply with the terms below.
  95. i. Right to Use and Distribute. The code and text files listed below are “Distributable Code.”
  96. · REDIST.TXT Files. You may copy and distribute the object code form of code listed in REDIST.TXT files plus any of the files listed on the REDIST list located at http://go.microsoft.com/fwlink/?LinkId=247115.
  97. · Third Party Distribution. You may permit distributors of your programs to copy and distribute the Distributable Code as part of those programs.
  98. ii. Distribution Requirements. For any Distributable Code you distribute, you must
  99. · add significant primary functionality to it in your programs;
  100. · for any Distributable Code having a filename extension of .lib, distribute only the results of running such Distributable Code through a linker with your program;
  101. · distribute Distributable Code included in a setup program only as part of that setup program without modification;
  102. · require distributors and external end users to agree to terms that protect it at least as much as this agreement;
  103. · display your valid copyright notice on your programs; and
  104. · indemnify, defend, and hold harmless Microsoft from any claims, including attorneys’ fees, related to the distribution or use of your programs.
  105. iii. Distribution Restrictions. You may not
  106. · alter any copyright, trademark or patent notice in the Distributable Code;
  107. · use Microsoft’s trademarks in your programs’ names or in a way that suggests your programs come from or are endorsed by Microsoft;
  108. · distribute Distributable Code to run on a platform other than the Windows platform;
  109. · include Distributable Code in malicious, deceptive or unlawful programs; or
  110. · modify or distribute the source code of any Distributable Code so that any part of it becomes subject to an Excluded License. An Excluded License is one that requires, as a condition of use, modification or distribution, that
  111. · the code be disclosed or distributed in source code form; or
  112. · others have the right to modify it.
  113. 3. INTERNET-BASED SERVICES. Microsoft provides Internet-based services with the software. It may change or cancel them at any time.
  114. 4. .NET FRAMEWORK SOFTWARE. The software contains Microsoft .NET Framework software. This software is part of Windows. The license terms for Windows apply to your use of the .NET Framework software.
  115. 5. MICROSOFT .NET FRAMEWORK BENCHMARK TESTING. The software includes one or more components of the .NET Framework (“.NET Components”). You may conduct internal benchmark testing of those components. You may disclose the results of any benchmark test of those components, provided that you comply with the conditions set forth at go.microsoft.com/fwlink/?LinkID=66406. Notwithstanding any other agreement you may have with Microsoft, if you disclose such benchmark test results, Microsoft shall have the right to disclose the results of benchmark tests it conducts of your products that compete with the applicable .NET Component, provided it complies with the same conditions set forth at go.microsoft.com/fwlink/?LinkID=66406.
  116. 6. SCOPE OF LICENSE. The software is licensed, not sold. This agreement only gives you some rights to use the software. Microsoft reserves all other rights. Unless applicable law gives you more rights despite this limitation, you may use the software only as expressly permitted in this agreement. In doing so, you must comply with any technical limitations in the software that only allow you to use it in certain ways. You may not
  117. · work around any technical limitations in the software;
  118. · reverse engineer, decompile or disassemble the software, except and only to the extent that applicable law expressly permits, despite this limitation;
  119. · make more copies of the software than specified in this agreement or allowed by applicable law, despite this limitation;
  120. · publish the software for others to copy;
  121. · rent, lease or lend the software;
  122. · transfer the software or this agreement to any third party; or
  123. · use the software for commercial software hosting services.
  124. 7. BACKUP COPY. You may make one backup copy of the software. You may use it only to reinstall the software.
  125. 8. DOCUMENTATION. Any person that has valid access to your computer or internal network may copy and use the documentation for your internal, reference purposes.
  126. 9. EXPORT RESTRICTIONS. The software is subject to United States export laws and regulations. You must comply with all domestic and international export laws and regulations that apply to the software. These laws include restrictions on destinations, end users and end use. For additional information, see www.microsoft.com/exporting.
  127. 10. SUPPORT SERVICES. Because this software is “as is,” we may not provide support services for it.
  128. 11. ENTIRE AGREEMENT. This agreement, and the terms for supplements, updates, Internet-based services and support services that you use, are the entire agreement for the software and support services.
  129. 12. APPLICABLE LAW.
  130. a. United States. If you acquired the software in the United States, Washington state law governs the interpretation of this agreement and applies to claims for breach of it, regardless of conflict of laws principles. The laws of the state where you live govern all other claims, including claims under state consumer protection laws, unfair competition laws, and in tort.
  131. b. Outside the United States. If you acquired the software in any other country, the laws of that country apply.
  132. 13. LEGAL EFFECT. This agreement describes certain legal rights. You may have other rights under the laws of your country. You may also have rights with respect to the party from whom you acquired the software. This agreement does not change your rights under the laws of your country if the laws of your country do not permit it to do so.
  133. 14. DISCLAIMER OF WARRANTY. The software is licensed “as-is.” You bear the risk of using it. Microsoft gives no express warranties, guarantees or conditions. You may have additional consumer rights or statutory guarantees under your local laws which this agreement cannot change. To the extent permitted under your local laws, Microsoft excludes the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
  134. FOR AUSTRALIA – You have statutory guarantees under the Australian Consumer Law and nothing in these terms is intended to affect those rights.
  135. 15. LIMITATION ON AND EXCLUSION OF REMEDIES AND DAMAGES. You can recover from Microsoft and its suppliers only direct damages up to U.S. $5.00. You cannot recover any other damages, including consequential, lost profits, special, indirect or incidental damages.
  136. This limitation applies to
  137. · anything related to the software, services, content (including code) on third party Internet sites, or third party programs; and
  138. · claims for breach of contract, breach of warranty, guarantee or condition, strict liability, negligence, or other tort to the extent permitted by applicable law.
  139. It also applies even if Microsoft knew or should have known about the possibility of the damages. The above limitation or exclusion may not apply to you because your country may not allow the exclusion or limitation of incidental, consequential or other damages.
  140. Please note: As this software is distributed in Quebec, Canada, some of the clauses in this agreement are provided below in French.
