  14. I am disgusted at the way Munir Farooqi A9693AQ has been treated in prison and how his right to independent health care has been totally neglected. Despite Munir's solicitor's continuous efforts to engage in clear, cohesive communication with you, you have proven to be negligent of the health affairs that desperately needed to be dealt with since November 2013, by delaying your responses which has only deteriorated Munir's health over time.

  16. The prison has a duty of care to Munir Farooqi whilst he is detained within the penal system. Article 3 European Convention on Human Rights provides as follows: “No one shall be subjected to torture or to inhuman or degrading treatment or punishment.” This right extends to access to treatment as a right to life.

  18. Since being at HMP Wakefield the admin station has frustrated independent medical experts from assessing Mr Farooqi. I understand whilst the prison have extended Article 3 ECHR in regards to his eyes. The prison still denies access to his medical expert.

Following the judgment in D v United Kingdom (1997) 24 EHRR 423, that a HIV patient could not be returned to a state of origin where medical treatment was inadequate, the duty of care extends to day to day matters and the well being of a prison. Therefore, all reasonable steps must be taken to prevent reasonably foreseeable harm or event that could lead to harm.

  22. Mr Farooqi was recently horrifically attacked by a prisoner who had been transferred to HMP Wakefield from HMP Frankland for attacking a Muslim prisoner! Within a short time the same prisoner attacked Mr Farooqi causing injury to his eye and eye orbit leaving him very badly bruised and unconscious. It is understood dispute CCTV is being used and monitored by prison staff so not only was the assault not deterred by prison staff, they also appear to have been reticent to intervene. Why was this the case?

  24. It has also been brought to my attention that the Muslim prisoners on Munir Farooqi's wing had been sent into segregation not long before Farooqi was attacked. This is deeply troubling news and we demand answers. Why was Mr Farooqi isolated from his associates a week before?

  26. I demand you stop frustrating the independent medical expert access to Mr Farooqi and you start an investigation into the placing of this prisoner on a wing with Muslim prisoners.
