Scenario 1:

Bob is a homosexual, and Casey knows this.  He is a long-time customer of Casey’s Cakes, a local shop dedicated to making confectionary delights.  Casey has served Bob as a customer on multiple occasions, including making a custom cake for a birthday party for Bob’s father, and a custom anniversary cake for Bob’s parents.

One day Bob enters Casey’s store and tells him excitedly that he is engaged to be married to David, and that he would like to have Casey bake their wedding cake.  Casey declines, stating that he cannot in good conscience bake a cake for a same-sex wedding.

Has Casey discriminated against Bob based on Bob’s sexual orientation?


Scenario 2:

One day Bob enters Casey’s store and tells him excitedly he is engaged to be married to Diane, and that he would like to have Casey bake their wedding cake.  This surprises Casey a lot, because he knows Bob is a homosexual, but he says he would be glad to bake their wedding cake.

What is different between this scenario and the first?  Bob’s sexual orientation hasn’t changed, and yet Casey is willing to bake a wedding cake for him.


Scenario 3:

Rick is a heterosexual, and Casey knows this.  He is a long-time customer of Casey’s Cakes, and has been served by Casey for many years.

One day Rick enters Casey’s store and tells him excitedly that he is engaged to be married to David, and that he would like to have Casey bake their wedding cake.  This surprises Casey a lot, because he knows Rick is a heterosexual.  Casey declines, stating that he cannot in good conscience bake a cake for a same-sex wedding.

Has Casey discriminated against Rick based on his sexual orientation?
