  1. Hi, thanks for visiting Xbox Support! I'm Jarrett F.
  2. 11:00 am
  3.
  4. Me
  5. hello
  6. 11:01 am
  7.
  8. Jarrett F
  9. How may I be of assistance?
  10. 11:01 am
  11.
  12. Me
  13. well i was talking to someone in the forums about someone who had a 360 console that was out of warranty.
  14. 11:01 am
  15.
  16. Me
  17. i understand that 3rd party repairs would cause an existing warranty to be void and prevent MS from being able to support this console any longer, but another user claimed they would also BAN and BRICK your console for ANY 3rd party repair. that seems extreme.
  18. 11:02 am
  19.
  20. Me
  21. he said ANY repair is considered "modding"

  25. If there is any foreign hardware or software on the console, then yes -- once you connect to Xbox Live / our servers, it may detect modification to the console and "ban" it from going on Xbox Live.
  26. 11:04 am
  27.
  28. Jarrett F
  29. That's a great a questions, though. Definitely.
  30. 11:04 am
  31.
  32. Me
  33. i understand "foreign" hw/sw. but say someone replaces your fan with another MS brand stock fan. there's nothing to detect. and xbox live bans aside, they aren't allowed to brick you console. if i remember correctly they were disabling consoles for certain mods a while back but were forced to stop doing that, as you cannot prevent someone from doing what they wanted with their owned hardware, just prevent someone from connecting to your privately owned servers. is that correct?
  34. 11:06 am
  35.
  36. Jarrett F
  37. Yeah, exactly -- as long as you're not connecting to our servers, or hosting modded lobbies, we don't necessarily know the console has been modified.
  38. 11:07 am
  39.
  40. Jarrett F
  41. You're also correct, a replacement fan is a replacement fan.
  42. 11:07 am
  43.
  44. Me
  45. ok well he insist that the terms of use state that MS can ban and brick for ANY 3rd party repair. i mean let's say i went on the forums and indicated that i had some hardware replaced, that would of course not be something detectable like a simple swap of a broken piece with an original. but admitting this on the forums, can MS read that and actually ban my console, assuming they would really want to?

  47.
  48. Me
  49. i know it's silly but i'm trying to see this from a theoretical legal standpoint
  50. 11:10 am
  51.
  52. Jarrett F
  53. I certainly have not heard of such a thing happening.
  54. 11:10 am
  55.
  56. Me
  57. where can i read the actual terms of use for 360 consoles? so far all i have been able to find is xbox LIVE tou, and xbox 360 warranty info.

  65. This touches on modifying of the console
  66. 11:12 am
  67.
  68. Me
  69. in the product manuals it just states that your warranty would be void, nothing about bans and certainly not bricking the console

  73. For example, I've got a coworker who cut the plastic on the top of his console for intense ventilation -- essentially fixing a red ring of death himself, and the console has not been banned.
