  1. Mr. Goodman claims his website is a "private organization" and is therefore exempt for releasing source for kernels that are posted on his message board.
  2.
  3. Anyone who signs up can readily download these kernels. The site and its forum serve as a hub for a perpetual beta test where nothing is ever released. This is despite the presence of almost daily kernel binaries and files such as anthrax-aosp-test1-public.zip which contain both a kernel and Busybox, all such files are claimed to be private despite being properly downloaded.
  4.
  5. Mr. Goodman's claims of GPL compliance can be found here. Some have since been removed in an attempt conceal their content:

  12. Over the course of the months since the highly public debate on the gpl-violations mailing list[1], the site has become "verified only", "invite only", and now "not a public website". I believe this is an attempt to continue systemic violation of the GPLv2.
  13.
  14. In addition to the above, I'd like to submit the following for your consideration of whether a violation or intent to violate has taken place.

  20. Is Mr. Goodman's GPL posture in line with the language and responsibilities of the GPLv2?
