  1. Dear Sir/Madam,

Certain content you are broadcasting through TuneIn, located at http://www.tunein.com/100-Hit-Radio-s131838/, was the subject of a takedown notice we received from Sony Music Entertainment ("Sony") pursuant to the Digital Millennium Copyright Act (“DMCA”). Sony has asserted ownership of certain music content, and that you are broadcasting this content through TuneIn’s streaming service without permission to do so.

Because the takedown notice appears to be largely complaint with the requirements of the DMCA, TuneIn will accept the allegations in the notice as true and, in compliance with the DMCA, will disable streaming of your station through TuneIn on or about Monday, November 16, 2015, unless you provide us with evidence that you have permission to broadcast this content and submit a counter-notification pursuant to the DMCA, which must include:
  6. (A) your physical or electronic signature;

  8. (B) identification of the material that will be removed or to which access will be disabled and the location at which the material appears;
  9.  
  10. (C) a statement under penalty of perjury that you have a good faith belief that the material would be removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;

  12. (D) your name, United States postal address, and telephone number; and
  13.  
  14. (E) a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which you reside, or if you live outside of the United States, for any judicial district in which TuneIn, Inc. may be found, and that you will accept service of process from Sony or an agent of Sony.
  15. As stated in our Terms of Use, repeated incidents of intellectual property infringement will result in the prohibition of your content from streaming through www.tunein.com. We also reserve the right to terminate broadcasters suspected of infringing intellectual property rights of third parties upon the first incident without further notice, at our sole discretion, and without liability to you. To prevent us from having to take these steps, please immediately remove and refrain from broadcasting on www.tunein.com any material for which you do not own the necessary rights.
