- The lease is limited in time and ends without prior notice on 30.09.2017
- The lessee has been advised by the landlord that lease agreement with respect to an imminent construction project, which results in the evacuation of the entire property, is expressly concluded only for the contractually fixed term of tenancy.
- This has been accepted by the tenant.
- The tenant's right to extend the tenancy is therefore expressly excluded.
- 7 Termination
- The tenant who withdraws prematurely shall be liable for the rent (including incidental costs) up to the date of the contract.
- If the tenant leaves the rented property prematurely, he is only released from his obligations towards the landlord if he proposes a new tenant who is reasonable and willing to accept the lease under the same conditions.
- For the examination as well as selection of the substitute hirer, the landlord is to allow sufficient time for the usual clarifications (at least 30 days).
- The costs associated with the extra-ordinary re-letting of advertising and additional activities shall be borne by the departing tenant.
- If the tenant dies during the course of the contractual relationship, the parties agree that the lease will be terminated automatically and without further delay.
- The termination date shall be the end of the month following the death of the tenant.
- If the tenancy agreement has been concluded with several persons on the tenant's side, the end of the month following the death of the last tenant mentioned in the tenancy agreement shall be the end date. This applies regardless of the existence of any heirs.
