  12. Section 1: The =|FF|= Clan
  13. The clan is a group of people pooling resources to maintain a friendly gaming environment. The public name of the clan is “Fatal Forces” with our tags being “=|FF|=”. This will strictly be a voting Gaming Community on all issues excluding disputes.

  18. Section 2: Purpose of Constitution
  19. The purpose of this document -- the Clan Constitution -- is to clearly answer these (and other) questions: - Who is an active member for the purposes of voting?
  20. - What are my rights as an active member?
  21. - What are my responsibilities as an active member?
  22. - How are clan funds to be approved and spent?
  23. - How will the clan be organized?
  24. - How the Clan Constitution can be added and amended to?

  26. Section 3: Definitions
  27. Section 3.1: Clan Organization
  28. The Fatal Forces Clan consists of members both active and Inactive, non-members, game servers, the =FF= website and TeamSpeak servers. There will be no official owner of Fatal Forces. This will strictly be a voting Gaming Community on all issues excluding disputes.
  29. Section 3.2: Members
  30. A "Member" is anyone who has been duly nominated and appointed by majority vote plus 1 vote of clan members present during a scheduled Clan Meeting.
  31. Active Member:
  32. An *Active member* is anyone who donates to the clan, provides services in the form of maintaining the servers and monitoring game play in the servers with other requirements as voted on and listed in the Clan Amendments.
  33. Inactive Member:
  34. An *Inactive member* is anyone who does not donated to the clan or fails to provides services in the form of maintaining the servers and monitoring game play in the servers with other requirements as voted on and listed in the Clan Amendments.
  35. Section 3.3: Players
  36. Players are either official =|FF|= member players or non-member players from the general public entering our servers for game play.
  37. Section 3.4: Donations
  38. Those monies donated by the Clan members and guests to maintain server function and Team Speak or as voted upon by the membership to maintain the clan’s interests.

  42. Section 3.5: Administrators Status or Levels (is this a definition)
  43. The following is a list illustrating the Administration hierarchy;
  44. All active members and those regular, long term and trusted non-member server players will or can be assigned Administration status. Normally these will consist of a Level 20, 40, 60 or 100 statuses indicating an increase in rights or privileges to server function.
  45. Super - Administrator Level 100
  46. Senior - Administrator Level 80
  47. Full - Administrator Level 60
  48. Trial or Temporary - Administrator Level 40 Moderator - Administrator Level 20
  49. Within this hierarchy there will be the need for the following positions to provide for a division of the workload needed to maintain the Clans interests and functions. One active member may be in more than one position at any one time. These positions will be as listed;
  50. Forums Moderators - They will be responsible for responding to any and all correspondence within the forums.
  51. Head Administrators – ??????
  52. Member Administrators - They will be responsible for monitoring and maintaining fair play in the servers.
  53. Non-Member Administrators - Those regular, long term and trusted non-member server players will or can be assigned Administration status for monitoring and maintaining fair play in the servers.
  54. Server Administrators - They will be responsible for maintaining and making recommendations needed to keep servers fully functional for game play. There may be as many as deemed necessary to achieve server functionality.
  55. Team Speak Administrators - They will be responsible for maintaining, assigning rights and making recommendations need to keep Team Speak fully functional for clan and player use alike.
  56. Clan secretary – They will keep minutes of all meetings and post notices for the clan as well as handling any correspondence needed to help clan functionality.
  57. Section 3.5: Committees Audit Committee:
  58. Three elected members from the clan that will, on a monthly basis, review the Finance Committees activities.
  59. Finance Committee:
  60. Three elected members from the clan that will oversee the Clan finances.
  61. Dispute Administrators Committee:
  62. They will handle all Clan disputes both personal and Clan related as needed where the membership at large cannot come to a consensus.

  66. Section 3.6: Game/TeamSpeak Servers
  67. These are computers running game and TeamSpeak software at a companies in the US.
  68. Section 3.7: Web Site
  69. The official web presence of the =|FF|= Clan. WWW.FATALFORCES.COM
  70. Section 3.8: Clan Expenses:
  71. Those expenses deemed by the Clan as essential to maintain clan and server functions or as voted upon by the membership to maintain the clan’s interests.
  72. Section 3.9” The “Clan”
  73. In the gaming world the word “CLAN” refers to a group of gamers who form a team to compete against others over the Internet in multiplayer games. For our purpose “Clan” will refer to the members of =|FF|= collectively consisting of both active and non-active members.

  75. Section 4: Membership
  76. A "Member" is anyone who has been duly nominated and appointed by majority vote plus 1 vote of the current clan membership that is present during a scheduled Clan Meeting. The Members rights, roles and responsibilities are described below.
  77. Section 4.1: Member rights:
  78. =FF= members are allowed and required to wear the designated “Member Tags” of “=|FF|=” in game.
  79. Administration rights will initially be assigned as either a Level 40 Admin or Level 60 Full Admin based on trusted game play and B3 experience.
  80. Section 4.2: An Active Member is:
  81. An elected member that:
  82.  donates to the clan
  83.  provides services in the form of maintaining the servers
  84.  monitors game play in the servers
  85.  uses TeamSpeak to regularly talk with other =|FF|= clan members
  86.  regularly posts in the =|FF|= website forum
  87.  attended most of scheduled clan meetings via TeamSpeak
  88.  meets other requirements as voted on and listed in Section 12 Amendments.
  89. Section 4.2.2: Active Member Support items:
  90.  All active members are required to support the costs of maintaining the servers through a monthly donation of $10. However, because of constant inflation $10 doesn’t buy what it used to, so even a small amount more will be cheerfully accepted.

  94.  While hardships do occur making these donations from time to time difficult to meet it is their responsibility to meet this obligation in order to continue as an active member. In such cases where donations are not met a reduction in Admin status will be reduced or removed until active status is achieved.
  95.  All active members are required to manage the servers for fair game play which would include removal of those players that are Trolling, Hacking or exhibiting racism. To record demo of players suspected of hacking and upload all demos where a ban was issued.
  96.  All active members are required to check the forums for posts related to Clan interests and Ban issues.
  97.  All active members are required to help moderate forum posts, including replying to ban appeals, retrieval and review or submitted demos, help or participate in the training of new admin in learning skills to manage the servers.
  98.  Demonstrate a willingness to help at a higher level to include restarting B3 and servers,
  99. Section 4.3.1: Inactive Member is:
  100. An *Inactive member* is anyone who:
  101.  has not donated to the clan in the last 90 days; or,
  102.  completed at least one of the other requirements listed above for an Active member
  103. Section 4.3.2: Inactive member penalties:
  104. An *inactive* member will be required to remove any “Member Tags” and will either relinquish or be reduced in any Admin rights until they can achieve an Active Member Status.
  105. Requesting re-instatement can be done by requesting an Active Status from a Dispute Administrator and fulfilling the other Active Member requirements.
  106. After an Inactive Period of 6 months those deemed as having an Inactive Membership status must at that time reapply for membership at a scheduled meeting and be re-voted back into the membership.

  108. Section 5: Voting
  109. Various functions of the clan require the approval of a majority of Active Members and voting will be performed during official scheduled Clan Meetings.
  110. Section 5.1: Who can Vote:
  111. Only *Active Members* may vote during a scheduled meeting. All active members are eligible to vote.

  115. Section 5.2: Proxy Voting:
  116. If an *active member* is unable to attend he can proxy his right to vote to another active member by posting his intention to do so in the forum. Vote by proxy will count as if the member was present in terms of active members in attendance for passing a vote.
  117. Section 5.3: Where and how we vote:
  118. Section 5.3.1: Voting is done online in Teamspeak and active members may assemble in the meeting “lobby” any time prior to the start of the meeting. When the meeting starts a Senior Admin will move you into the meeting channel. You are expected to maintain proper decorum anytime the clan meeting moderator announces that discussion of an item is concluded and voting begins. Any member not able to maintain proper decorum, during a vote, may be expelled from the meeting.
  119. Section 5.3.2: A “yes” vote will be indicated by muting your microphone as a visual indicator that you are voting “yes.” Conversely keeping your microphone “un-muted” visually indicates you are voting “no”. The meeting moderator will announce when the voting is over, vote recording is complete and when all members may, at their discretion, un-mute their microphones.
  120. Section 5.3.3: Recording the vote will be done by the meeting secretary. The secretary will record the vote by taking a screen-shot; which shall be preserved in a folder somewhere within Teamspeak. The Dispute Administrator(s) shall determine the location of the folder.
  121. Section 5.4: Clan spending votes:
  122. Any vote that proposes new clan spending must be *Announced* at least 7 days in advance of when the meeting with the vote will be held. A simple majority vote is required for passage of any proposal.
  123. Section 5.5: Amending constitution votes:
  124. All votes that amend this document or that relate to spending of clan funds must be approved by a 66% or greater majority of Active members.
  125. Section 5.6: Removing active member votes:
  126. All votes to remove an Active member from the clan must be approved by a 66% or greater majority of Active members.
  127. Section 5.7: All other votes:
  128. All other Agendas dealing with the Clans operational affairs will be passed by a margin of 51% or greater of active members in attendance (including proxy) to approve the vote.

  133. Section 6: Committees
  134. To function smoothly our clan or Clan will have the following committees:
  135. Section 6.1: Audit Committee:
  136. Three elected members from the clan that will, on a monthly basis, review the Finance Committees activities. They will be charged with reporting their findings to the Membership at meetings or as requested. The purpose being to make sure that all expenditures by the Finance Committee are appropriate in maintaining the clans’ interests.
  137. Section 6.2: Contract Committee
  138. When needed Clan members will form a committee to negotiate computer server and/or other contracts as needed to manage the Clans’ interests. Negotiation experience is preferred to serve on this group.
  139. Section 6.3: Finance Committee:
  140. The Finance Committee’s purpose will be making sure that all expenses are paid and/or brought to the membership for a vote to approve any expenditures needed to maintain the clan’s interests. This committee will be charged with creating and maintaining any and all PayPal, or like accounts and Bank accounts. At least two *active members* are required to have joint access to the PayPal/Bank funds as clan Finance Members.
  141. Three active clan members, duly voted on during a scheduled clan meeting, of the clan will oversee the Clan finances. They agree to only spend clan money as approved by this constitution and to report finances to the Audit Committee as requested.
  142. Section 6.3.1: Reimbursements
  143. If a clan member pays for an item out of their own pocket, with and after the clan’s approval to spend them, shall be reimbursed to the member out of clan funds.
  144. Section 6.4: Finance reporting
  145. The finance committees shall prepare monthly reports detailing all clan donations and expenses. These reports will be in the form of MS Excel spreadsheets and converted into PDF documents for dissemination by the Audit Committee to the general =|FF|= members for review. The financial reports shall be posted to a folder on Teamspeak and into a place on the =|FF|= website which is accessible only for active =|FF|= members.

  147. Section 7: Administrators
  148. Section 7.1: Dispute Administration
  149. The Dispute Administrators - There will be (HOW Many?) that will handle all Clan disputes as needed. Dispute Administrators will be elected by the membership at large to manage the clan in the event of personal issues or issues that the membership at large cannot come to a consensus. Their decisions will be absolute and final.

  153. While interpersonal disputes are inevitable considering the fact we are all human, such disputes should be kept personal and away from the knowledge of the general membership especially while in Teamspeak. Those individuals are encouraged to find a private channel and discuss any differences in hopes that a mutual understanding can be reached. Failure to follow this guideline can result in a discussion and vote to remove the offending member.
  154. Dispute Administrators will be elected by the membership at large to manage the clan in the event of personal issues or issues that the membership at large cannot come to a consensus. These Dispute Administrators will, when more than one is running for any particular position, be elected by the membership at large. They will need to obtain a simple majority vote to hold a position. Length or duration of said position is to be decided.
  155. The Dispute Administrators will handle all Clan disputes as needed. Their decisions will be absolute and final. A recall of any one Dispute Administrators can be initiated by a 3⁄4 polling of the membership at large and then voted on for removal.
  156. Section 7.1: Head Administrators: ??????? Section 7.2: Forums Moderators:
  157. They will be responsible for responding to any and all correspondence within the forums. This will include greeting new potential members plus reviewing demos and handling ban appeals.
  158. Section 7.3: Member Administrators:
  159. They will be responsible for monitoring and maintaining fair play in the servers. Another duty will be making recommendations for issuing the Admin Levels to both Member and Player Administrators. They will notify members and players of changes to their Admin status or Level and why such changes have occurred prior to any Level change. Administration rights for clan members will initially be assigned as either a Level 40 Temporary Admin or Level 60 Full Admin based on trusted game play and B3 experience. They can request from higher level Administrators the following;
  160. • Imposition of longer Bans for Hacking
  161. • Instillation of PHP RCON based on experience
  162. • Instillation of Echelon based on experience
  163. Section 7.4: Non-Member Administrators:
  164. Based on recommendations of Member Administrators those regular, long term and trusted non-member server players will or can be assigned Administration status for monitoring and maintaining fair play in the servers. The maximum Level will be 40. They can request from higher level Administrators the following;
  165. • Imposition of longer Bans for Hacking
  166. • Removal of Bans made in error
  167. Section 7.5: Server Administrations:
  168. They will be responsible for maintaining and making recommendations needed to keep servers fully functional for game play. There may be as many as deemed necessary to achieve server functionality.

  172. Section 7.6: Team Speak Administrators:
  173. They will be responsible for maintaining and making recommendations needed to keep Team Speak fully functional for member and non-member players use alike. There may be as many as deemed necessary to achieve Team Speak functionality. They will also be solely responsible for assigning the level of rights in Team Speak.

  175. Section 8: Finances Section 8.1: Donations
  176. Those monies donated by the Clan to maintain server function and Team Speak or as voted upon by the membership to maintain the clan’s interests. A monthly donation of $10 and ceded to the clan PayPal account is required of all members and requested from those non-member players to support these needs.
  177. Section 8.2: Funds Uses:
  178. All donations will be strictly used for the singular purpose of maintaining server function. Member reimbursement of expenses as outlined in 6.2.1 will be the only exception to this rule.
  179. All clan monies will be used solely for the following:
  180. • =|FF|= website domain name renewals
  181. • Game and TeamSpeak web hosting
  182. • Maintaining the Gaming Server(s) operation and other needs
  183. • Promoting the clan with the general public
  184. • For the benefit of the clan and its members
  185. Section 8.3: Expenses/Spending:
  186. Any monies needing to be spent beyond those appearing in the listing above will require a Membership Meeting and approving vote.

  188. Section9: ProcesstoAmend Section 9.1: The Club Constitution:
  189. Amendments to this constitution will require a vote of the Clan and all active members are requested to attend a schedule meeting where a vote or votes will be cast. Any amendment must pass with a minimum of 66% or greater of active members present during the voting process.

  193. Section 9.2: Voting Process:
  194. Any vote that proposes to amend The Clan Constitution must be *Announced* with at least 14 days notice of when the meeting with the vote will be held.
  195. Section 9.3: Vote Announcement
  196. Any vote that proposes to amend The Clan Constitution must be *Announced* with at least 14 days notice of when the meeting with the vote will be held. A vote will be deemed to be *Announced* if a summary of the item to be voted on with appropriate subject is sent with at least two of the following methods:
  197. - A post in the Member’s Only section of the forum - A note on the Teamspeak Meeting channel
  198. - An email sent to all members
  199. Section 9.4: New Spending:
  200. Any vote that proposes new clan spending must be *Announced* at least 7 days in advance of when the meeting with the vote will be held.
  201. Section 9.5: Spending Vote requirement:

  208. Section10: Clan Meetings
  209. Clan meetings are necessary for the proper functioning of the clan and all =FF= members are expected to attend if at all possible. The nominal clan meeting lasts one hour but can occasionally run longer.
  210. Section 10.1: Monthly Meeting:
  211. The Clan meets once a month, with the date and time to be posted in Team Speak and the “Member Only” section of the forums. Meetings are done via Teamspeak; please assemble in the meeting “lobby” prior to the start of a meeting. A Senior Admin will move you into the meeting channel.

  215. Note: It would be nice for all members to stay after the meetings and engage in game play for a round or two to socialize with the Clan and perhaps talk to a member or members you have not yet met.
  216. Section10.2: Meetingnotifications:
  217. • A post in the member’s only section of the forum
  218. • A note on the Teamspeak Meeting channel
  219. • An email sent to all members
  220. Section 10.3: Non-attendance
  221. Life has a way of upsetting all of our schedules so “no-shows” are not penalized up to and until a member is absent for a period of six months. After that “steps will be taken.”

  223. Section11: ClanEmails
  224. Authorized Members of the Clan may contact you from time to time for clan business. This may include, but is not limited to:
  225. - asking if you are still alive and well
  226. - informing you of upcoming clan events (meetings, important votes, etc.)
  227. By being a member you agree to receive this and other emails from the clan, so make sure that the email provided us during your Clan registration process and contained in your Clan website profile is current and correct.

  229. Section12: Amendments
  230. Amendments or change to this Constitution can be made at scheduled meetings by listing proposed additions or subtractions for the Clan Members consideration. This listing or proposed alteration needs to be in the form of a common downloadable format and left in the proposing members folder in Team Speak.
  231. It is the Active voting Clan Members responsibility to secure a copy and be familiar with the proposed changes as to allow them to make an informed vote at the next scheduled meeting.
  232. Amendments to this constitution must pass with a minimum of 2/3 or 66% of active members present during the voting process.
  233. Section 12.1: There are no amendments at this time.
