  1. To Heads of Delegation of the Administrative Council
  2. 11 February 2016
  3. Update on B2B
  4.
  5. Dear colleagues,
  6.
  7. At its meetings of 2 and 17 February, 828 concentrated on the issue of the social
  8. unrest within the EPOffice. ln addition, a meeting took place on the 10 February
  9. between the Administrative Council Chairman, Deputy Chairman and the Chairman
  10. of the BFC, and the President, VP5 and the President's Chef de Cabinet. The aim
  11. was to explore the possibility of the cooperation between the President and the
  12. Council to address various social issues, and in particular the disciplinary cases
  13. involving SUEPO leaders.
  14.
  15. The Council members of 828 reiterated what the Council has stated repeatedly, not
  16. least that the handling of disciplinary cases was one of the major obstacles to
  17. reaching consensus with the trade unions on an MOU. We also made clear that
  18. these disciplinary cases had triggered very serious concerns as the political level
  19. about the proper functioning of the organisation.
  20.
  21. Unfortunately, we have not been able to engage in a meaningful dialogue with the
  22. President. We therefore saw it as unavoidable to translate the serious concerns of
  23. the Council members into a formal request to be addressed to the President. A copy
  24. of 828's draft document setting out this request is attached. lts aim is to give a fresh
  25. and strong impetus to solving the most important and urgent problems currently
  26. facing the organisation.
  27.
  28. At the 828 meeting on 17 February, the President rejected the document, in
  29. particular questioning the legal basis of the first and second requests. On the
  30. question of legality, it is obvious to us that there is no obstacle whatever to the
  31. Council making requests to the EPoffice President. lt is then for the President to
  32. respond positively to such requests. We are convinced that there are solutions which
  33. are legally possible, the more so as no one is likely to challenge the requested
  34. external review and parallel suspension of pending cases.
  35.
  36. It is intended to submit the attached proposal to the Council, for a decision at its
  37. March meeting, making a formal request to the President. Unfortunately, it was not
  38. possible to discuss the March Council agenda as a whole before the President left
  39. the 828 meeting. Nevertheless, you will receive the agenda for the March meeting in
  40. due time.
  41.
  42. On behalf of 828 Colleagues,
  43.
  44. Best regards,
  45. Jesper
  46.
  47.
  48.
  49. DRAFT
  50. DECISION
  51.
  52. The AC, in its capacity as supreme organ of the EPOrg -
  53.
  54. having repeatedly expressed its deep concerns about the social unrest within the
  55. EPOffice;
  56.
  57. having repeatedly urged the EPOffice President and the trade unions to reach
  58. consensus on an MOU which would establish a framework for negotiation between
  59. social partners;
  60.
  61. noting that disciplinary sanctions and proceedings against SUEPO leaders have,
  62. among other reasons, jeopardised such consensus;
  63.
  64. noting without taking position on the justification of these disciplinary sanctions and
  65. proceedings, that they are widely questioned;
  66.
  67. recalling the importance and urgency of the structural reform of the BOA;
  68.
  69. recognising the important institutional role of the AC and its dependence on a well-resourced
  70. and independent secretariat;
  71.
  72. Request the EFOffice President -
  73.
  74. to agree to an external review of the disciplinary sanctions and proceedings
  75. against SUEPO leaders;
  76.
  77. to suspend these disciplinary proceedings pending the outcome of the review;
  78.
  79. to submit to the AC a draft revision of the Staff Regulations which incorporates
  80. investigation guidelines (including the investigation unit) and disciplinary procedures
  81. which have been reviewed and amended;
  82.
  83. to achieve, within the framework of the tripartite negotiations, an MOU
  84. simultaneously with both trade unions, which would have no pre-conditions or
  85. exclude any topics from future discussions;
  86.
  87. submit proposals to the AC at its June 2016 meeting, after discussion in 828, for
  88. immediate implementation of the structural reform of the BOA, on the lines of the 5
  89. points agreed by the AC at its December 2015 meeting and of the legal advice given
  90. by Prof. Sarooshi, and taking into account comments from the Presidium of the BOA;
  91.
  92. to submit proposals to the AC at its June 2016 meeting, after discussion in 828, for
  93. reinforcement of the AC secretariat and a clarification of its position in terms of
  94. governance.
