  1. While any linux kernels released to the general public by me will have full source code (as well as installable zip files)
  2. posted at https://bitbucket.org/chadgoodman858, this site may offer linux kernels that are not to be released to the general
  3. public. At no time is anyone, including staff, authorized to distribute any private-use kernel outside of this organization.
  4. Since this means these kernels are only to be used internal to this organization, per GPL law as posted at
  5. http://gpl-violations.org/faq/sourcecode-faq.html, it is written in plain, clear and simple language that I do not need to
  6. release any source code.

  9. When you registered, you clicked the "I agree" box at the bottom of the page, just above that box was a text box of what you, the
  10. users, were agreeing to. Contained within that box was a summary of the agreement below, as well as a (non clickable) link to a html document
  11. with the same information you see below.

  17. Section I – Definitions
  18. Quote:
  19. a) Anthrax Kernel: is definded as any and all kernels, drivers, and/or software developed in whole or part by Chad Goodman.
  20. b) Organization: is defined as anthrax-kernels.us
  21. c) Developer: is defined as (but not limited to) Chad Goodman.
  22. d) client: is defined as anthrax-kernels.us
  23. e) member: is defined as registered users of the organization who volunteered to test products of the orgainization.
  24. f) user: is defined as registered users of the organization who volunteered to test products produced by the orgainization.
  25. g) user agreement: is defined as this document, and attached exhibits and documentation.
  26. h) source code: is defined as the entire source tree use to compile all the binaries and drivers enclosed with the software package.
  27. This may include binaries that are not considered to be part of the core kernel.
  28. i) kernel: is defined as the core kernel enclosed within zImage. The kernel does not include device drivers and/or external objects,
  29. internal or external to zImage. The kernel, if released to the general public, is to licensed under GPL version 2
  30. j) device drivers: is defined as all parts of the software package and/or zImage, other than the core kernel itself. If the device
  31. boots without it, it is not part of the core kernel. Device drivers may contain open and/or closed source device drivers. Closed source
  32. device driver source code will not be licensed under any GPL or GNU license agreement, and source code may not be released by any
  33. “member” of the “organization”
  34. k) software package: is defined as any and all parts of the published ZIP file used to install “Anthrax Kernel”, including scripts,
  35. abootimg, and other tools not part of the “kernel” used to enhance, install, or manage the “kernel”
  36. l) device: is defined on any piece of hardware the “software package” can be installed on, including, but not limited to: HTC REZOUND,
  37. HTC 3D CDMA, HTC 3D GSM

  39. Section II – Availability and Distribution
  40. Quote:
  41. a) “Antrax Kernel” are only available to members of the “organization”. Distribution and/or use outside of the “organization” is
  42. prohibited. If a “member” decides to distribute the “developer's” work outside of the “organization”, the “member” is obligated to comply
  43. with ALL GPL license requirements, as well as the restrictions in place by any non disclosure agreement(s) in place.

  45. Section IIa – Use of binaries and source
  46. Quote:
  47. a) “members” are volunteers of the organization who have chosen to test “anthrax kernel” and provide valid, complete, and honest feedback
  48. and problem reports (if needed)
  49. b) “members” are entitled only to compiled binaries only. Sr. Principals of the “organization” are entitled to binaries and source code.

  51. Section III – Implied non disclosure agreement
  52. Quote:
  53. a) “members” shall refrain from providing binaries, source, and other contents of the “software package” to anyone outside of the “organization”
  54. b) “members” shall refrain from any attempts to decompile, reverse engineer, and/or decrypt any part of the “software package”
  55. c) “members” shall refrain from disclosing any privileged information found in any thread or documentation provided by the “developer” or the “organization”

  57. Section IV – General Terms of Use
  58. Quote:
  59. a) “members” found to willfully violate the “user agreement” may have their rights to use the enclosed software revoked, with or without notice, as well as
  60. be expelled from the “organization”
  61. b) “members” shall assist in troubleshooting any issues with the “software package”
  62. c) “members” who post the “software package” and/or parts of the “software package” shall be in violation of the “user agreement” and will be bound to the
  63. rules of the GPL license agreement. Since “members” are not entitled to “source”, they will be unable to comply with GPL, the “organization” and/or
  64. “developer” is not obligated to provide “source” to assist “members” with compiling with GPL rules. “members” will also be solely responsible for any legal
  65. action that may come from their actions, even if the “member” is expelled from the “organization” under section IV-(a).
  66. d) in the event a “member” releases possession of their “device”, it is their responsibility to remove any and all works developed by the “developer” or
  67. provided to the “member” from the “organization”

  69. Section V – Implied Agreement to “user agreement”

  71. a) it is implied that a “member” who downloads any “software package” developed by the “developer” agrees to the all the terms in the “user agreement”
  72. b) it is implied that a “member” who makes any post on any thread, article, forum post related to the software produced by the organization, on any web site
  73. agrees to all the terms in the “user agreement”
  74. c) it is implied that a “member” who has concerns and or questions about any part of the “user agreement” has had their concerns or questions resolved and/or
  75. answered before they have agreed to the “user agreement” under section V-(a) or V-(b).

  77. Section VI – Additional Information

  79. a) by downloading the “software package” or any part of the “software package”, the “member” also agrees to the following:

  81. b) upon termination of membership, either involuntary or voluntarily, will discontinue use of any binary acquired from this organization and destroy any copies they may have in their possession.
