Former detective sentenced for misconduct in a public office

  6. A former Detective Inspector based in Specialist Operations has been today, Thursday 31 July, been sentenced for misconduct in a public office and breach of data protection following a trial at Southwark Crown Court.

  8. Afiz Khan, 46, (11.07.1967) was sentenced to six months custodial - suspended for two years and was ordered to pay £500 court costs within six weeks.

  10. He pleaded guilty to both counts.

  12. He was formally dismissed without notice for gross misconduct from the Metropolitan Police Service (MPS) on 13 June following a misconduct hearing.

  14. Chief Superintendent Alaric Bonthron, Directorate of Professional Standards said: "We set the highest standards for our officers.

  16. “A fundamental element of public confidence in the police service is the trust that the service will deal appropriately with sources of information and evidence, and that the access afforded to such information should be for police purposes only and will not be abused.

  18. “The actions of Afiz Khan are clearly discreditable conduct and a breach of confidentiality. He has acknowledged his actions and pleaded guilty at the first opportunity.”

  20. Also appearing at the court was Aisha Ali-Khan, 33 (1.08.1980) of Keighley, West Yorkshire. She was given a 12 month conditional discharge.

  22. She previously pleaded guilty on 23 June to intentionally encouraging obtaining personal data without consent, contrary to Section 44 of the Serious Crime Act 2007.

  24. On 5 December 2012, both were arrested following an investigation by the Directorate or Professional Standards into a complaint from a member of the public.

  26. The trial heard that Aisha Ali-Khan encouraged Afiz Khan to misuse resources at his disposal, to investigate people who had sent various emails to her - contrary to Section 44 of the Serious Crime Act 2007.

  28. The investigation discovered that Afiz Khan obtained CCTV from South Yorkshire police which he had no authority or good reason to obtain. It also discovered that he had disclosed restricted information to his wife, Aisha Ali-Khan.

  30. On 24 July 2013 Aisha Ali-Khan was charged with misconduct in a public office for intentionally encouraging obtaining personal data without consent, on or about the 24th August 2012.

  32. The next day, 25 July 2013, Afiz Khan was charged with two counts of misconduct in a public office and four counts of data protection offences between May and September 2012 (inclusive).

  34. In December 2013, he appeared at Southwark Crown Court and pleaded guilty to counts one and three of misconduct in a public office. The remaining two were left to lie on file

  36. They were subsequently sentenced as above.
