  5. Here is some information that can be viewed @ gnu.org for GPL v2 software:

  7. Chad can sell his kernel, and he has the right to refuse to sell it to specific people he if sees fit.
  8. Chad can charge for the source code. so as long as the price of the source code does NOT exceed the cost of the kernel itself. There is NO limit to what Chad can charge for the kernel.
  9. Source needs to be made available only to "users of the software" and only if "requested" by the "user of the software" - and yes, as stated above, a fee can be charged for access to the electronic download of source, as long as it is no more than the cost of the kernel.

  11. Yes, people who "buy" the kernel can share it with who they want with or without a charge, but Chad still has the right to charge for source if the "3rd party" requests source.

  13. People who purchase his kernel will get an written offer for source. So people who actually purchase the software can request source, or pass the written offer on with copies of the software.

  15. The written offer for source will contain directions on requesting source. It will also contain a unique code that identifies the actual kernel it belongs to, so the "correct" source could be provided. Source for any other kernel than want is identified on the written offer will not be honored.

  17. Copies of the written offer will be acceptable, as most likely it will be emailed as a PDF to the purchaser.

  19. Requests for source without the written offer provided by Chad, with a valid unique identifier will NOT be honored.

  21. So, yes - Chad's kernel is for sale. Wish to purchase it, PM him directly. If you have a VALID written offer for source, fill it out and send it in to the address on the form with your payment. Once the payment is verified, and it clears the bank - source code will be provided.

  23. There are NO restrictions on what you can do with the kernel or source, once you acquire it. If someone shares a build, it is up to then to provide the receiver of the build with a valid written offer for source. If the person sharing fails to do so, that person is in violation of the GPL, not Chad, or any member of his team.

  25. GPL can be enforced on the person "distributing" the kernel, and that may or may not be the author of the kernel.
