  8. In May 2015, The Leland Stanford Junior University Marching Band was placed on social suspension by Stanford's Title IX office and the Organizational Conduct Board of the Office of Community Standards.

Based on the investigative report, the University has serious concerns about the Band's ability to safely manage certain events consistent with the University's Alcohol, Controlled Substances and Hazing Policies. More significantly, the University has found that certain aspects of events must not recur, even were the Band at some point in the future permitted to reinstitute the specific event. These restrictions include the following:

  23. 1. Effective immediately, the Band is prohibited from hosting, sponsoring or otherwise supporting any events or activities with alcohol or with controlled substances. After the conclusion of the 2015-2016 academic year, the Band may seek permission for approval from Student Affairs staff to host events involving alcohol consistent with the law and University alcohol policies; controlled substances are never permitted.

  25. 2. The Band is permanently prohibited from coordinating, hosting and/or in any way sponsoring a Tahoe Ski Trip for its members.

  27. 3. The Band is prohibited from hosting Bandquet or ExSexNextSex events for the next academic year, 2015-2016. During the 2015-2016 academic year, the Band and its leadership will work with designated University administrators to ensure that the event can be appropriately reintroduced, absent any hazing, sexualized elements, or alcohol-based awards for the 2016-2017 school year.

For academic year 2015-2016, the Band is prohibited from traveling with any athletic team to participate and/or play at away athletic events (including post-season tournaments, bowl games, or games at UC Berkeley or in San Francisco/Santa Clara). The Band is permitted to play at athletic events hosted at Stanford, as requested by the athletics department. In addition, the Band will be permitted to perform at certain non-athletic events, including those that may require limited travel (e.g., Stanford 2015 commencement, Special Olympics, Picnic Day at UC Davis), provided that the expectations in this letter are fully complied with. After the conclusion of the 2015-2016 academic year, the Band may submit a written petition to the Title IX Office and Student Affairs requesting approval to have the travel restriction lifted, in whole or in part. Such petition must demonstrate full compliance with the requirements of this letter and evidence of substantial progress in changing Band culture.

  31. Modifications to Existing Policies and Training

  33. 5. To address identified concerns regarding aspects of Band practices that contribute to a sexually hostile environment, the Band is required to implement the following remedial measures prior to the start of the 2015-2016 academic year, and ongoing:

  35. 6. The Band will review its band songs, website, and any related social media pages to ensure that they do not contain any inappropriate material of a sexual nature, including nicknames, song lyrics or similar content.

  37. 7. The Band either will: (a) stop using an interview process for Dollié selections; or (b) vet questions in advance with appropriate University officials and ensure that a University official is present during each interview. In addition, questions or requests to perform actions of a sexual nature will be eliminated, as well as inappropriate questions regarding religion. Rather, the questions will be aligned with the specific responsibilities to be performed by the successful Dollié candidates (e.g., time commitment; dance ability).

  39. 8. The Band will review and update any member handbook or policies to ensure that University policy regarding sexual harassment, alcohol, and hazing are clearly incorporated.

  41. 9. All new and existing members of Band will be required to participate in in-person training as well as receive materials developed by OAPE, the Title IX Office and the SARA Office prior to the start of the 2015-2016 academic year. This training will be required on an annual basis with a reminder to Band members at the start of each quarter. Topics covered will include the University's hazing and alcohol/controlled substances policies, what constitutes gender- based harassment/sexual violence, the role of the Title IX Office, resources and reporting options, and healthy sexual relationships and bystander intervention techniques. In addition, all members will be provided a copy of the administrative remedies contained in this letter and University conduct expectations for Band members.

With the support of Student Affairs staff and its Alumni Board, the Band will proactively explore strategies to cultivate a culture of respect while still honoring traditions and fostering a fun atmosphere. This information will be used to provide regular culture-centric training and activities to Band members that focus on the University's Fundamental Standard and the need to cultivate an inclusive, positive, respectful Band culture. Part of these strategies could include a kick-off retreat by the Band to enhance student buy-in to culture change and emphasize the importance of these issues.

  45. Failure of the Band and any of its individual members to full comply with one or all of the above items may result in immediate suspension of the Band. In addition, violations of the alcohol, hazing, controlled substances, and/or Title IX policies may result in individual Band members being referred to the Office of Community Standards for further investigation and any appropriate discipline.
