Youtuber stole my logo

hello everybody, first of sorry for my bad english..

I’m going to tell you one of my stories, and this one is about plagiarism, counterfeit of one of my drawings by a Youtuber (Shaclone) . You know, it happens to me that I can create fan arts, drawings, etc… Some of my friends asked me to create a beautiful drawing/logo/banner for them or to use one of my existing drawings. The only thing I can ask back is to put a link to my facebook page if they share it on social networks or to do not modify without my authorization. Now, let’s begin with my story. It was one year ago, I found on a FB group a picture of my Shaconymous that I have created. Here is my drawing : http://bit.ly/2foDiPw The picture found was completely modified, I left a comment to the guy who posted it and told him that the least that you could do would be to ask me for permission. The reply was “lmao it’s not from you and I took it from google”. Yo what? I made an image search in google of my Shaconymous : nothing. Then I made an image search of the modified drawing and I saw a lot of pictures of my Shaconymous !! Where does this phenomenon come from? I was a little artist and I found my drawing on different foreign websites. How?
With some research again, I found a youtuber named “Shaclone”. You know who he is. But I didn’t. This “logo” he has used, was mine, he uses it without any authorization. Let’s sum up the facts : - No credits : violation of copyright - Marketing without any consent : counterfeit
Then I took the time to contact him. Sadly Shaclone strongely denies that the selling of my logo is illegal and It can bring to prosecution. To sum up, the discussion was “Oh no, this drawing was pixelated and I have to rework on it, and if the logo is successful, it’s thanks to me. YEAAAAAAAH but no. Not even credible. He sold t-shirts, I have retroactive rights on it. But no, Mister wanted absolutely to tell me “NAH BUT YOU ONLY THINK ABOUT MONEY, YOU ARE A GOLD DIGGER”. Ehhh.. we will see if you can say the same thing in front of a judge. So. The asked price was too expensive for him. Should I tell you that he told me “I can delete the logo, no prob’, I can get a logo from somebody else for 50$ and he would create it peacefully”. Oh okay, thanks for telling me that but it’s not like by simply deleting the logo you can just get out of it 😊. In the end of the discussion, I couldn’t find an agreement, it was impossible. No. REAAAAAAALLY?! To explain to you my point of view, imagine that you’re a builder, you built a nice house, a guy comes to squat your house for months and then he says: “So ehm… for 500$, I want your house.” “Eh… It is for the food right? for the rent? And then you leave huh?” “Uh no. 500$ for the house and I don’t pay for the squat.”
Ok… no precipitation. I contact a friend who works in the law with the help of my mother (thank you mom). With this person, I got to know my rights and with the help of other illustrators in a FB group. I HAVE a retroactive right. IF the person wants to keep using the logo, he must PAY the price (that is to say MY price). In other countries, the law about drawings and arts isn’t the same. In France, as long as I have made the fan art, I have moral rights on it at least 😊 credits). One year after the discovery of the facts, I didn’t have a lot of time to care for a big case like that (it never happened to me or it concerned only little youtubers/persons who got the respect to delete my work or to give me credits without any commercial uses). If he doesn’t want to pay my logo, he must delete all of contents who contain my logo. Let’s take this exemple : It’s not because you have paid the rent you didn’t pay that you have the right to keep the house. You leave if you don’t pay in the future. (Normal). So.. What am I going to do? I have a file against him, with proofs of my authorship, a recorder of the vocal, screenshots, etc… (I have the original file of my drawing and a .png file and both have an earlier date than the release of my logo by Shaclone). I have illustrators who support me, who say “You don’t have to be afraid, you have rights, you have to claim them. I know that I don’t have any “real” knowledge because I’m an amateur, but if you have questions, I will try to answer.
Please, if you have done a fanart : Write where the character comes from. It’s ugly to appropriate Mario/Link/Kirby by saying that it’s your original creation. If you copy a fanart : don’t say that it’s from your own imagination ! Some of you draw, we know that it’s you who have drawn it but the idea doesn’t come from you. The STRICT minimum of respect is to do not appropriate a character/work without an authorization. I know myself that it happens to me to post pictures found on my news feed on my page but damn I have never stolen any work. I have never said that it was MY work and if I can (by google search), I give credits to the original artist (For example : Justduet with her League of Kitty). You know that plagiarism is bad (with the drama with Math Podcast and Moretoki on Youtube), a shit, it sucks, it’s boring for the creator.
