  1. My service in the basement is spotty so some messages do not appear in order.

  5. "Hi Eric, Yatan will not be home over the next few months. Feel free to reach out to me if you need anything, for any payments, opening of the laundry door and the dates you will be here and or will be leaving. Thank you."
  6.
  7. Me
  8. 10:55 PM
  9. "Okay, thank you also at some point this week, I would like to talk to you and discuss some important topics just so we are on the same page. In regards to my move out date, it will be November 30th."
  10.

  12. 10:58 PM
  13. "Okay thank you. Feel free to call me to speak or message. I will be extremely busy over the next few weeks."
  14.
  15. Anu
  16. 10:58 PM
  17. "Have you paid rent for this month and the next or will you be?"
  18.
  19. Me
  20. 10:59 PM
  21. "That is what I would like to discuss with you in person."

  25. "I'm fine with you messaging."

  29. "Okay so the reason for my eviction was for family to move in, correct?"
  30.
  31. Anu
  32. 11:01 PM
  33. "Yes, that is correct."
  34.

  37. "As of September a new bill was passed to protect renters from landlord's evicting tenants
  38. in bad faith and using the reason that their family would be moving in as a viable reason.
  39. Not saying that is the case here, but the bill is called Bill 128: Rental Fairness Act."
  40.
  41. Me
  42. 11:04 PM
  43. "It mentions something about compensation in the event I am evicted for this reason.
  44. I can show you sources and we can verify this together. I mentioned this to Yatan but he never replied back."
  45.
  46. Anu
  47. 11:09 PM
  48. "Yes I understand that bill very well as I am a real estate agent. The bill does protect the rent but only
  49. if I do not have proof that my brother in law and mother in law genuinely need a place to live, which I do have.
  50. If you'd like I can provide you with a written statement of their need to live in the basement and also provide
  51. you with a legal OREA agreement of a one year term that they will sign effective December 1st. If for any reason
  52. I cannot provide this, it would be only then that the renter would not pay rent for 60 days (If last month has been paid)"
  53.
  54. Me
  55. 11:10 PM
  56. "If you can provide me with the affidavit, I would appreciate that. Once that is provided and verified I will gladly pay rent for November if that is the case."
  57.
  58. Anu
  59. 11:12 PM
  60. "Not a problem at all, I will get back to you with the legal paperwork shortly, most likely a couple of weeks."
  61.
  62. Me
  63. 11:13 PM
  64. "Perfect, thank you."
  65.
  66. Anu

  68. "In this case you would need to pay this months rent and would not for the last months as you have already paid.
  69. This bill was passed because people used this excuse as a means of eviction but there is solid proof that they do actually need a place to live. The renter needs to pay in this case. My brother of record is my real estate lawyer and I have confirm this with him. Feel free to confirm my sayings with the tenant board. If I provide with legal documentation of my family members urgency to move in with a one year contract to rent. The bill then of course will not apply."
  70.
  71. Anu
  72. 11:15 PM
  73. "Also FYI, I don't think you ever had a contract for 6 months or a year. Because there is no contract the bill does not apply if you are month to month."
  74.
  75. Me
  76. 11:16 PM
  77. "I also do not recall being given an eviction notice in writing that went through the LTB. I will seek legal council in order to double check, I do not seem to be rude but I just need to make sure it is my right as a tenant or not."
  78.
  79. Anu
  80. 11:23 PM
  81. "I thoroughly apologize for Yatan's behavior. He never really communicated well with you and in some cases took a little extra time to get things done. I completely understand your concern around your place of living. We actually are not evicting you, Eric. We verbally agreed to end our month to month term which is a very common thing for basement apartments. To be quite honest I am a victim of abuse and was able to build up enough courage to call the police on Yatan two days when he had beaten me up severely. Yatan was the main earner in our home and it will make things very hard on me and my children if I didn't have the rent for the month oweing. I completely understand you wanting to seek legal council so please do. Also the bill is more or less for renters renting in apartment buildings. In your case your renting a room in a basement so in most cases it wouldn't apply in this situation. I would love to have kept you since your a great tenant. I just need a place to keep my mother and brother in law more than than ever now. I apologize if I've given too much information."

  85. "Also please let me know if you need any help finding another place or require a reference as I would be happy to be one. Thank you, feel free to let me know if you've found anything else about the bill and if in fact I am wrong in any way. Just text me if you will be paying rent or not."
