  2. Military Law: Overview
  3. The Armed Forces Act (AFA) of the U.S. Marine Corps, applies and covers all employed personnel of MCBC-Lejeune (USMC). Your representation outside of the HQ or other official structures is to be bound by the rules and regulations hereby mentioned. You are a representative of the U.S. Marine Corps and will abide by our laws as well as the organization you're visiting.

  5. Anyone considered 'active' within the Military culture, including members of other military's as well as VIPs are considered subject to the rules and regulations outlined in this document.

  7. The Military Police Officer (5803) is the internal security and policing organization. It is their responsibility to ensure legislation is correct and up to date. It is also their responsibility to uphold and enforce any discipline throughout the Marine Raider Regiment. Anyone misbehaving or disobeying the law will be dealt with by the MP Personnel.

  12. Strict Liability Offences:

  14. Strict Liability is liability for MENS REA which is Latin for ‘guilty mind’. This means that there does not need to be intention behind this offence. No matter what the circumstances are that surround the offence, the Defendant MUST receive a punishment, REGARDLESS of where he/she INTENDED to break this offence or not.

  16. Military Police Investigations:

  18. Investigations for crimes committed will conducted by MP and any appeals will be directed to the MP department where it will be held and analyzed, to determine whether the:

  20. I. The offender knew the offence was a crime;
  21.  
  22. II. Had the intention to commit a crime;
  23.  
  24. III. Intended mischief (i.e intended to cause problems for any personnel for any reason)
  25.  
  26.  
  27. If the Offender meets ANY of these 3 criteria then the offence will be treated just as a Strict Liability Offence and punishment is unavoidable.
  28. However, if the offender does NOT meet any of these criteria, the offender will be given a warning or depending on the nature a lesser charge.

  30. No personnel can claim against a sanction for the same offence twice, as obviously the second time round they will know it is a crime.
  31. Sanctions will be logged by the Military Police and kept on record by MP.

  33. Punishment for these contraventions of the (AFA) is dependent on the situation and the person. Yet this does not mean that someone with a history of sanctions will receive a harsher punishment.

  71. The Infraction system for The Marine Raider Regiment will be split into 3 groupings;
  72. Within these said 'groupings' it will broken down into 3 levels; In which "Crime Level-III" being deemed as the most severe.

  77. SL - Serious Level

  79. PI - Possible Infraction

  82. 1. Dual Level Infractions simply mean that the charge can be either a Possible Infraction or a Serious Level Infraction. This will be determined by the Military Police.

  84. 2. Possible Infractions are events or occurrences where either a Formal Warning or a Infraction is issued to the offender.

  86. 3. All (SL) Serious Level Crimes or Crime Level III & will result in a serious demotion or even Dishonourable Discharge.

Personnel who are Fired or Dishonorably Discharged as a result of (SL) or Crime Level III punishments or an accumulation of other Infractions will not receive any benefits from the military, including referrals for transfers, VIP and pardons; Unless said Personnel submit a pardon request to an MP. The person in question will be responsible in proving their innocence and explain as to why the punishment should be recanted.

  100. Desertion (SL) CL-III:
  101. A person subject to service law commits an offence if he/she deserts.
  102.  
  103. I. A person is subject to service law if he/she is absent without leave and;
  104. II. He/she intends to remain permanently absent without leave; or
  105. III. He/she intends to avoid a period of active service.
  106.  
  107. Insubordination (D) CL-II:
  108. A person subject to service law commits an offence of;
  109.  
  110. Misconduct/Insubordination towards a superior officer (D) CL-II:
  111.  
  112. I. A person subject to service law commits an offence if;
  113. II. He/she acts violently against a superior officer; and
  114. III. He/she knows or has reasonable cause to believe that B is a superior officer.
  115.  
  116. Disobedience to lawful commands (D) CL-II:
  117.  
  118. I. A person subject to service law commits an offence if;
  119. II. He/she disobeys a lawful command; and
  120. III. He/she intends to disobey, or is reckless as to whether he disobeys, the command.

  122. Obstruction (SL) CL-III:
  123. A person subject to service law commits an offence if;
  124.  
  125. I. He does an act that is likely to put at risk the success of an action or operation;
  126. II. He intends to prevent, or is reckless as to whether he prevents, the success of the action or operation.
  127.  
  128. Cowardice (SL) CL-III:
  129. When an officer or person who holds a position of command is absent without leave (AWOL) for a period of more than 10 consecutive days.
  130.  
  131. Other Jobs/Double Jobbing (SL) CL-III:
  132. For holding jobs in other military’s or groups that haven’t been approved or authorized.

  134. I. A person subject to service law commits an offence if;
  135. II. Participates in any other Military duties other than the Marine Raider Regiment
  136.  
  137. Disclosure Violations (D) CL-II:
  138. Failure to properly disclose information.
  139.  
  140. I. A person is subject to service law if he/she;
  141. II. Fails to report any problems or conflicts of interest that would result in a member being unable to perform their duty.
  142.  
  143. Incompetence (PI) CL-I:
  144.  
  145. I. A person subject to service law commits an offence if;
  146. II. accepting a commission or position that you know is far beyond your abilities; or
  147. III. upon finding out that a commission or position is far above your abilities not reporting the problem to a superior officer;
  148. IV. accepting a commission/position and not completing the duties.
  149.  
  150. Unauthorized Acts / Disobey Forum and Regulations (SL) CL-III:
  151. Performing acts or actions for which the member is not authorized to do.
  152.  
  153. I. A person is subject to service law if he/she;
  154. II. Calls off any alliance without permission to do so; or
  155. III. Carries out intelligence missions on other said militaries;
  156. IV. Carries out any raids; or
  157. V. Carries out war tactics that weren't confirmed by the Marine Raider Regiment
  158.  
  159. Neglect of duty (PI) CL-I:
  160. Failure to act with the prudence that a reasonable person would exercise under the same circumstances.
  161.  
  162. I. Failure to attend for or perform duty
  163. II. A person subject to service law commits an offence if, without reasonable excuse, he/she;
  164. III. Fails to attend for any duty;
  165. IV. Leaves any duty before he is permitted to do so; or
  166. V. Fails to perform any duty.
  167.  
  168. Making false records (SL) CL-III:
  169. A person subject to service law commits an offence if;
  170.  
  171. I. He/she makes an official record, knowing that it is false in a material respect; and
  172. II. He/she knows or has reasonable cause to believe that the record is official.
  173.  
  174. Disgraceful conduct of a cruel or indecent kind (D) CL-I:
  175. A person subject to service law commits an offence if;
  176.  
  177. I. he/she does an act which is cruel or indecent; and
  178. II. his doing so is disgraceful.
  179.  
  180. Mutiny (SL) CL-III:
  181. Leading or participating in an insurrection;
  182.  
  183. I. In concert with at least one other person subject to service law, he/she;
  184. II. Acts with the intention of overthrowing or resisting authority; or
  185. III. Disobeys authority in such circumstances as to subvert discipline;
  186. IV. He/she agrees with at least one other person subject to service law to overthrow or resist authority.
  187. V. A person subject to service law commits an offence if—
  188. VI. He/she knows that a mutiny is occurring or is intended; and
  189. VII. He/she fails to take such steps as he could reasonably be expected to take to prevent or suppress it.

  191. Impersonation (D) CL-II:
  192. The unauthorized usage of another persons name, likeness, or credentials to issue commands or gain access to rooms or information.

  194. I. A person is subject to service law if;
  195. II. copies the rank and uniform of any personnel; or
  196. III. creates an account similar of any personnel
  197.  
  198. Corruption (SL) CL-III:
  199. The act of abuse of power
  200.  
  201. I. A person subject to service law if;
  202. II. tries to either silence or marginalize opposition, or;
  203. III. Show undue favor to friends.
  204.  
  205. Espionage (SL) CL-III:
  206. The act of being a spy or handing out information to other groups or people.
  207.  
  208. I. A person is subject to service law if;
  209. II. he/she is contracted by another military organisation to;
  210. III. disrupt or harm the Marine Raider Regiment; or
  211. IV. to gather intelligence on the Marine Raider Regiment
  212.  
  213. Treason/High Treason (SL) CL-III:
  214. The act of maliciously or intentionally acting to disturb, disrupt, or harm the military.
  215. The act of providing aid or information to sworn enemies of the military.
  216.  
  217. I. A person subject to service law commits an offence if—
  218. II. Without lawful authority, he/she discloses information that would or might be useful to an enemy; and
  219. III. We/she knows or has reasonable cause to believe that the information would or might be useful to an enemy.
  220. IV. A person subject to service law commits an offence if, without lawful excuse, he intentionally;
  221. V. Communicates with an enemy;
  222. VI. Gives an enemy information that would or might be useful to the enemy;
  223. VII. Fails to make known to the proper authorities any information received by him from an enemy;
  224. VIII. Harbors or protects an enemy.
