  16. How may I help?
  17. Ben at 15:08, Feb 25:

  19. Alex at 15:09, Feb 25:
  20. Fantastic, please let me know what questions you have and I will answer those queries as best I can.
  21. Ben at 15:11, Feb 25:
  22. Thanks, straight forward question first, I understand that you offer a hosted CRM for client interaction and that reseller customers are able to charge what they want for packages, BUT, what is to stop Heart Internet from matching (based on an established brand) or undercutting a reseller to cut out the middle man whilst getting access to everything that is commercially sensitive?
  23. Alex at 15:15, Feb 25:
  24. The number of customers we have it would not be viable to try and price match all of them. We have set pricing for our products you can create on the reseller package numerous and bespoke pricing. It is also unethical for us to do so.
  25. Ben at 15:18, Feb 25:
  26. it is, but then the whole industry is i'm afraid. What protection is included, for example, are protections included within the contract/terms and conditions? In the most extreme situation, if you were HUGELY successful (somewhat limited by how apparently competitive the industry is vs the requirement to purchase services from you (as opposed to a blank canvas with access to everything for a set price with unlimited restrictions), then it seems to me that you'd end up taking a major hit (on selling at 50% less than to end users) and it would be extremely tempting to mitigate those losses by taking a nosey under the bonnet
  27. Alex at 15:23, Feb 25:
  28. There is no specific documentation that I think of to give to you to reassure you. It will be covered within our terms and conditions here: https://www.heartinternet.uk/terms As previously mentioned it would be wholly unethical for us to attempt to poach customers in the way in which you are implying and would likely lead to legal proceedings and losing our customer
  29. Ben at 15:25, Feb 25:
  30. I don't believe it is actually something that is legally enforceable from my law degree rather a long time ago unless it's specifically stipulated in a contract which makes me even more weary, a contract is set in stone whereas terms and conditions always contain an ability to vary
  31. Ben at 15:26, Feb 25:
  32. generally, this is why non competes exist
  33. Alex at 15:28, Feb 25:
  34. There is unfortunately nothing further that I can give to reassure you, it would not be in our interests to do what you are suggesting.
  35. Ben at 15:28, Feb 25:
  36. yep, for precisely the reason that it leaves the company open to poach customers which is entirely unethical
  37. Ben at 15:28, Feb 25:
  38. as you've said yourself
  39. Alex at 15:30, Feb 25:
  40. Thank you for your query, there is not anything further that I can offer in terms of advice in this instance.
