Mario Aguirre is denied bail; Will take his trial in prison

The judge considered that granting the bond to the accused brings a risk of his possible evasion. He also reflects that in this case, what is appropriate is to deny the accused provisional freedom.

HERMOSILLO.- Seventh Judge Heleodoro Reyes Medina of Hermosillo denied bail to Mario Humberto Aguirre Ibarra, who was arrested last Wednesday.

Imputed for the case of alleged violent dispossession of the property of Villa Toscana to the detriment of the Gutierrez Luken family in the capital of Sonora, now the friend and sponsor of the former Governor Guillermo Padrés Elías will remain imprisoned in the Social Readaptation Center of Hermosillo.

In the resolution, the judge considers that the accused is also being investigated by the Attorney General's Office ( Procuraduría General de la República), which means that granting him bail would risk the possible escape of Aguirre Ibarra.

"This would suspend the present process, which would affect the human right of access to justice to the detriment of the offended," reasons the judge.

In that sense Judge Reyes Medina said that the public prosecutor who brings the criminal case provided elements to establish that the freedom of the accused represents by its previous conduct and circumstances of the crime committed a risk to the offended party or to society, furthermore there is a suspicion that the alleged perpetrator could escape from the action of justice.

The judge reflects that in that case, it is appropriate to deny provisional freedom.

In this regard it is mentioned that the accused is indicated in national media as who deposited 3 million 312 thousand dollars in an account of the, then governor, Guillermo Padrés, and that that subject is under investigation by the General Department of Control of the Deputy Attorney of Regional Criminal Procedures and Protection ( Dirección General de Control de la Subprocuraduría de Control Regional de Procedimientos Penales y Amparo) of the same PGR (Attorney General of the Republic).
