  6. This is exactly why you get a good lawyer when dealing with divorce, child support, or anything really. It may seem expensive at the time, but getting caught in a bad divorce/separation agreement will bleed you dry for many times more than the legal fees you would have paid at the start.
  7. Reading through his summary post on this saga, it's pretty easy to see that he entered into a really terrible divorce agreement from the start. Even with a very basic understanding of family law I can tell you there are several red flags that should have never been agreed to; interest on a ED of a defunct business (the asset is dead and bankrupt, what is there to distribute)? no child support to him (except for a few months) for the 5 years his son lived with him? Monthy ED payments on top of alimony that exceed many times over his actual income (inability to pay is a huge material consideration for revising the payments downward)? Paying her legal fees (lmao, hell fucking no)? Not proactively moving to have the payment schedule revised when his job circumstances changed? Having the interest and fines thrown out (at this point it seems that those alone exceed 50% of the original sum)? Alimony and some payments like this ED that are incident to divorce are IRC 215 federal tax deductions - was he taking advantage of this?
  8. I feel really bad for him and I hope his attorney can get things straightened out. Yes the system can be really fucked up, but you have to avail yourself of the available legal remedies and fight for yourself - otherwise you'll just have your money and freedom taken from you.
  9. Edit: Regardless of how people feel about how he got in this mess, I think we can all still wish him well as a fellow EVE nerd. However, I do want to caution people against getting too caught up in trying to help financially. The EVE community is extremely generous, as seen by the community fundraiser to help the late BC's wife & kids after he passed - but unless you know him personally, and want to help him with a full understanding of the situation, don't blindly dole out your hard-earned $ because of this story. We've seen too many people abuse the EVE community's sympathy and generosity, and although i'm not at all saying that's what's happening here, its best we keep out wallets out of a man's divorce troubles.

  12. The whole thing reads so strangely that I don't think we have the full story. Based on past communications from him, I think the likely situation is that Rixx took some chances to maximize the portion of his business that he was able to retain in the divorce.
  13. Seems likely that the business hit peak valuation around the time of the divorce, which sucks, but I would venture a guess that Rixx got additional upside in the business based on the agreed-upon split in the divorce (he keeps equity in the business, agrees to make a set of payments over time to ex-wife out of the cashflow of the business). That's a gamble that the business is going to be worth more than the payments you give up, and it seems like Rixx lost. The ex-wife should be upset that she didn't get paid; sounds like she gave up the equity upside for the certainty of cash but ultimately got neither. I'm guessing that paying her legal fees relates not to the initial divorce but to subsequent proceedings to collect. Who knows, though, Rixx has consistently failed to provide a clear picture of the original agreement.

  93. Going to jail for not paying a debt is a very extreme measure, which means we're missing a HUGE amount of the story here. None of us are really in the position to know the whole truth, but based on the information that is shared here, this sounds like a hole of his own doing. 15 years is a long time to go without at least making small token payments, and not paying your taxes on top of this basically shows he/they don't make sound choices in general. I don't wish jail on anyone, but he probably isn't there because the system is unjust and gave him zero chances to not go to jail. Millions of people exist in this country unemployed and underemployed without having any legal trouble at all.

In the Evoganda post, I'm reading that this debt relates to an ED bill handed down by her lawyer in January 2012, after the business went bankrupt, which should have caused anything tied to 'future earnings' to become zero.

The only thing that's clear is that there is more to the story than this particular post indicates. The last part still stands, even if the other stuff is BS.   105. Not to sound insensitive, but I had some debt issues after college. They weren't anything like this, but I certainly found myself in a hole. I got a job at two miserable fast food restaurants and worked non stop until it was paid and I could start law school. So I feel for the dude not being able to make a living the way he wants, but the man had the option to (a) sit around and make nothing because he couldn't have his dream job or (b) go to McDonalds and get this shit paid off.

  113. Rixx once blogged about me and about a dishonorable 1v1 which I never agreed to. He even proceded to fix the chat logs about it. It was at the same time me and my mates discovered that he lies about a lot of different things in his blog and in-game.

I'm not educated enough on the subject to say I definitely think it's BS, but from what I do know, it sounds like BS. I haven't heard an argument that convinces me anyone should pay money to their ex after their marriage ends (Edit: just for having been married and now not, any other business deals or actual debts owed are a different story)

In this case, from what I've heard (I have not personally verified this part of the story) he and his ex-wife co-owned a company before they divorced, and as part of the divorce offered to buy out her half. He then proceeded to run the company into the ground and refused to pay out because now the company was worth nothing.   663. Take an old, decrepit house or apartment building that's practically condemned, and fill it with people who just got out of prison and have zero job prospects. Never do any maintenance or anything, but do post a parole officer there 24/7 to kick in doors (don't replace the doors) and arrest your tenants for petty bullshit.
  664. It's basically prison without bars, but the moment you come back to the HH smelling of beer or other substances, you get sent back to prison for a parole violation.
  665. They are also notorious for shakedowns and shit, where corrupt cops will steal anything of value that the HH tenants were given or earned and the parolees can't do anything about it.

  673. The idea is that people in prison can't get jobs. Some people in prison don't have anywhere to go.
  674. Therefore, the state should provide a place for them to get "their affairs in order."
  675. It's supposed to be a boost on the way out. Unfortunately, most people can't wrap their heads around the idea that criminals are people, and should be helped instead of executed, and you end up with a system that's underfunded and overfilled, and that just invites issues.

  678. It's not, really. Re-integration into society is priority zero for the US Justice system, and there are almost no social programs to help a paroled felon readjust to society.
  679. The halfway house is basically just a place for the parolee to squat until they either break parole and go back to prison, or are allowed to live on their own or with family.

I think you've missed the mark in calling the community black hearted as it was largely members of the EVE community who supported Rixx's previous goFundMe campaigns to help him purchase a ridiculous amount of equipment in an effort to help SUPPORT his dreams of gaining employment as a graphic designer.

  701. I agree on a lot of this. Going to jail for debt is typically for child support (which is absolutely ridiculous). However in a case like this the courts are clearly fed up with purposeful non compliance. You will not be thrown in jail for simply having debt.... you will be thrown in jail for purposely ignoring it, not addressing it with the court system, and all in all acting like a d bag. I'm not defending the joke of an American legal system just making it clear this is a very special circumstance... which typically means something was done to puss the judge off royally. Something like making zero attempt to respect the courts decision over a 15 year period.

  704. This is true; believe it or not courts hate putting a guy in jail over non payment of child support. Some view it as debtors prison, most acknowledge there's no way they're going to make any money if they're in jail, etc. But if you thumb your nose at the court and your ex for a decade and a half you're probably going to go inside for a while.
