Steven Ungar Robert Calo Lane Powell 601 S.W. Second Avenue Suite 2100 Portland, OR 97204 Mr. Ungar and Mr. Calo, Your firm currently employs Mr. Dwight Holton, who is a candidate for the office of Oregon Attorney General. As citizens of Oregon, we demand that you disclose and clarify the following items: We call on you to disclose all financial and non-financial assistance which Lane Powell has provided to Dwight Holton's campaign for Attorney General. By the Holton campaign's own admission to the Portland Mercury, Lane Powell has been providing office space for Mr. Holton to conduct campaign activities. To date, neither your firm nor Mr. Holton have reported this contribution to the Secretary of State's office. In fact, as reported by the Mercury, the Holton campaign has stated that they don't intend to disclose this information until AFTER the election. We call on Lane Powell to provide an explanation of the circumstances around Mr. Holton's employment at your firm. On January 4th, Mr. Holton resigned from his job as U.S. Attorney. At the time, he 'declined to comment on any political plans'. On January 7th, he started working in your firm's 'White Collar Criminal Defense' team. Just 4 days later, on January 11th, Mr. Holton announced his candidacy for Oregon Attorney General. The timing and circumstances raise some troubling questions: Did you or anyone at Lane Powell discuss Mr. Holton's intention to run for Attorney General while he was still employed as the U.S. Attorney? Were the terms of Mr. Holton's employment with Lane Powell in any way tied to a decision to run for Attorney General? Did Lane Powell offer employment and campaign support in exchange for preferential treatment for their clients, in the event Mr. Holton were to be elected as Attorney General? Are Lane Powell's clients providing campaign contributions, either financial or non-financial, through compensation to Mr. Holton? Given the nature of his work at Lane Powell, the suspicious timing of his resignation as U.S. attorney and subsequent hiring by your firm, plus the fact that Lane Powell is currently providing non-financial assistance to Mr. Holton's campaign, these events all cast doubts on the belief that Mr. Holton can be an independent advocate for the people of Oregon. Your clients are a who's who of corporations that regularly face prosecution for mortgage fraud, price-fixing, pollution, and violating worker's rights. As Attorney General, the people of Oregon would be counting on Mr. Holton to defend them from the formidable resources of these corporations. Also disturbing is your firm's employment of Rep. Shawn Lindsay, who has taken vast amounts of campaign cash from out of state corporate interests in the past year. As you know, he is a legislative member of the American Legislative Exchange Council's Public Safety and Elections Task Force, which is responsible for providing model legislation like Florida's 'Stand Your Ground' law and various measures restricting voter access for minorities, seniors and students. In the Oregon legislature, Rep. Lindsay has sponsored many of ALEC's 'model bills'. ALEC's corporate membership includes many of your clients. Because of your firm's ties to ALEC, and the fact that you employ a candidate for Attorney General and a member of the Oregon House of Representatives, we ask that you disclose any ties, past or present, that you have to ALEC and its legislative and corporate members. We also ask that you publicly renounce ALEC and its legislative agenda, and pledge your support for efforts to subject it to the same regulations and restrictions that apply to all other lobbying firms. We'll be watching and listening. Sincerely, The 99% of Oregon
