RULES These are the official rules that govern how the Xbox One advertisement Glitch Contest promotion for Halo will operate. This promotion will be simply referred to as the "Contest" throughout the rest of these rules. In these rules, "Microsoft", "we", "our", and "us" refer to Microsoft Ireland Operations Limited. "You," "yourself" refers to an eligible Contest entrant. “The Promoter” is Microsoft Ireland Operations Limited, 70 Sir John Rogerson’s Quay, Dublin 2, Ireland for the purposes hereof, “Territory” shall mean: The United Kingdom. 2. ELIGIBILITY Subject to the requirements set forth in Section 6 below, the Contest is open to any anyone residing in the United Kingdom and the United States of America; 50 United States and Washington DC who is 18 years of age or older (the "Required Age") at the time of entry, and who has not been judicially impeded from acting on its own. Proof of age, identity and place of residence may be required and requested. upload) 3. ACCEPTANCE When entering into this Contest, you will be requested to accept fully and unconditionally these Terms and Conditions (“T&Cs”) and to agree to be bound by them. You also agree to abide by the terms and conditions of any third party website or service where the Contest is hosted, if any. STATEMENT OF AGE By entering into this Contest, you are stating that you are of the Required Age to participate in the Contest. 5. ENTRY PERIOD This Contest runs from 12:00 GMT on Friday 1st May 2015 and closes 23.59 GMT on Friday 22nd May 2015 inclusive, (the “Promotional Period”). Entries received outside of the Promotional Period will not be considered. 6. TO ENTER (a) ENTRY REQUIREMENTS To enter into this Contest, you must: Solve the puzzles on the journey to visit a URL and be taken to these T&Cs. You must then accept the T&Cs to be taken to the next step of the journey. The competition requires a team to win. A team of four people (all usernames need to be different people) must be the same team the whole way to win) Entrants that satisfy the entry requirement will be eligible to enter into this Contest as long as they form part of a team of four entrants. An entrant can form their own team or alternatively there is the option to be automatically placed into a team with three other single entrants. It is not possible to enter this competition as a single entrant, only four people teams are eligible. Only one (1) entry per person per journey path will be accepted so once an entrant has been assigned to a team, they cannot join another team and start the journey path again. An entry is qualified by the following: the entrant must complete the pre-determined steps, as part of a team that form a path with a dedicated start and end point. These have been created by parties working with Microsoft. This will involve numerous code-breaking and puzzle-solving activities that progress a consumer through a logical journey. Multiple journey paths have been created, each culminating in the opportunity to gain access to a prize. Participants of journey paths which offer physical prizes shall be required to further submit personal information securely at later stages should they successfully reach the final stages of such journey paths before any other participant. The submission of such personal information is to enable prize fulfilment and will include, but will not be limited to the user’s name, address and email address. Successful participants of the Contest (the 4 members of the winning team) will be asked to provide photographs of themselves which will be used to create characters of the winning team so that they can be immortalised in Halo 5. By signing this T&C’s document, participants must agree to have their rights used in the particular way decided by Microsoft in order to immortalise them in Halo 5. As well as personal information used for contact, the winning team will be immortalised in a Halo fiction series. By accepting these T&Cs, they relinquish their rights to the use of this series. (b) CONTEST DESCRIPTION This is a skill-based Contest and chance plays no part in the determination of the winner(s). The object of this Contest is to complete the tasks before other competitors. For the purpose of this Contest, each time you accept the T&Cs and embark on a journey path to complete the tasks, you submit what will be called an “entry.” (c) DISQUALIFICATION We will automatically disqualify: any incomplete or illegible entry; OR any entries that we receive from you that are in excess of the entry limit described below; OR any entrant whose entry (in the reasonable belief of the Promoter) is not in accordance with these Terms and Conditions or who (in the reasonable belief of the Promoter) tampers with the entry process or is otherwise involved in any way in manipulating, interfering or tampering with this promotion or engages in any un-sportsman-like or dishonest conduct of any kind. Errors and omissions may be accepted at the Promoter’s absolute discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. (d) ENTRY LIMIT The use of automated devices to enter this Contest is prohibited. The Promoter is not responsible for lost, corrupted, illegible or delayed entries or for network, computer, hardware or software failures of any kind which may restrict or delay the sending or receipt of your entry. Only one (1) submission per eligible member per journey path during the Promotional Period will be accepted as an entry (for avoidance of doubt, the maximum number of entries for each journey path in the Contest per eligible member is one (1). USE OF YOUR ENTRY: Other than what is set forth below, we are not claiming any ownership rights to your entry. We are not responsible for any unauthorized use of your details or entry by visitors to this website. While we reserve these rights, we are not obligated to use your details or entry for any purpose, even if you have been selected as a winner. If you do not want to grant us these rights to your entry, please do not enter this Contest. 9. SELECTION OF WINNERS Entry to the Contest does not guarantee that you will receive a prize. Except as expressly stated below, only one (1) entry per person is permitted. Potential winners will be determined by the first person or persons to decipher and complete the hidden tasks that form the consumer journey paths which have been created for entrants to progress through. This criterion is objective. Winner’s determination is final, non-appealable and binding 10. ODDS OF WINNING Odds of winning depend on the number of entries received and the level of skill of each entrant. If there is a dispute regarding a potential winner, we will consider the potential winner to be the authorized account holder of the email address used. CONTACTING WINNERS Winners of prizes will be asked to provide certain personal details (which will include, but not be limited to name, address and email address). Attempts to contact such winner(s) will begin from Friday 22nd May 2015, using the details provided when requested at the end of the journey and winner(s) will be asked to respond to emails sent to them from an Independent Prize Fulfilment Agency. These emails will ask for confirmation of the user’s identification and address and will request the winner(s’) preferred delivery address, (for prizes sent via post), and will include a time to respond by. If such emails are not responded to within the period listed on the winner(s) notification messages, the winner(s) will forfeit his/her prize and the prize may either be offered to a runner up or retained by Microsoft. It is your responsibility to respond, as a winner. We will not enter into discussion beyond this point. This process will continue until, if applicable, attempts to contact the runner up are exhausted. McCann London will be responsible for contacting the winners and Microsoft will organise prize fulfilment, travel, accommodation and expenses. 11. PRIZES: The prize pool is as follows: For the winning team (4 entrants): Each team member will be invited to provide a photograph of themselves which will be used to create characters in their likeness to appear in the game Halo 5. Winners will be required to complete a publicity release and grant Microsoft all rights to use of their likeness for any purpose. You may not exchange your prize for cash or any other merchandise or services. However, if for any reason an advertised prize is unavailable or if it is unlawful to supply the prize to you in terms of the laws of your country of residence, we reserve the right to substitute a prize of equal or greater value; and You may not designate someone else as the winner. If you are unable or unwilling to accept your prize, we will award it to an alternate potential winner amongst the runners up referred to above; and If you accept a prize, you will be solely responsible for all applicable taxes related to accepting the prize, if any; an Unless otherwise noted, all prizes are subject to their supplier’s warranty and / or terms and conditions. There are different ways that prizes will be delivered: Digital prizes will be sent via email to the winner after completion of the journey by the independent fulfilment company. Physical prizes will be delivered within 28 working days from the closing date of the competition: 23.59 GMT on Monday 29th December, unless otherwise specified. The Grand prize will be delivered within 42 days of the competition closing date. The grand prize winner may be contacted separately about their prize its delivery. The Promoter is not responsible for any delays in the postal service. 12. WINNERS LIST You hereby grant Microsoft Corporation and its affiliates the right to publish your name in online and offline media for this Contest, in case you are a winner. The eventual winner may be requested (which request you may decline) to participate in further publicity or advertising without remuneration, which may include the use of their Xbox LIVE Gamertag for advertising and publicity purposes. LAWS These Terms and Conditions, the conduct of this Contest and the interpretation and enforcement of these Terms and Conditions shall be governed and construed exclusively in accordance with the laws of the participant’s country of residence. Nothing herein shall deprive you of any more favourable terms that could apply to you under the laws of the participant’s country of residence. For residents of Great Britain only: The provisions of the Contracts (Rights of Third Parties) Act 1999 shall not apply to this agreement. 14. AMENDMENT To the extent permitted by applicable law, the Promoter reserves the right to amend, modify, cancel or withdraw this Contest and to amend these Terms and Conditions at any time without notice. If cheating, a virus, bug, catastrophic event, or any other unforeseen or unexpected event that cannot be reasonably anticipated or controlled, (also referred to as force majeure) affects the fairness and /or integrity of this Contest, we reserve the right to cancel, change or suspend this Contest. This right is reserved whether the event is due to human or technical error. If a solution cannot be found to restore the integrity of the Contest, we reserve the right to select winners from among all eligible entries received before we had to cancel, change or suspend the Contest. If you attempt to compromise the integrity or the legitimate operation of this Contest by hacking or by cheating or committing fraud in ANY way, we may seek compensation from you for any losses that we incur as a result of your actions to the fullest extent permitted by law. Further, we may ban you from participating in any of our future Contests, so please play fairly. 15. LIABILITY Microsoft cannot guarantee the performance of any third party and shall not be liable for any act or default by a third party. Participants in this Contest agree that Microsoft will have no liability whatsoever for any injuries, losses, costs, damage or disappointment of any kind resulting in whole or in part, directly or indirectly from acceptance, misuse or use of a prize, or from participation in this Contest. The foregoing shall apply in the event your data or your entry is not received or lost by Microsoft. Nothing in this clause shall limit Microsoft’s liability in respect of death or personal injury arising out of its own negligence or arising out of fraud. The provisions of this Section shall apply to the maximum extent permitted by applicable law. 16. DATA Any personal data relating to entrants will be used solely in accordance with current data protection legislation applicable in your country of residence and in the country where the data controller is located.
