Second Avenue Suite 2100 Portland, OR 97204 Mr. Holton, As a candidate for Oregon Attorney General, you are expected to uphold and exemplify the ideals of full disclosure, transparency and integrity. We have some questions about your commitment to these ideals. We have questions about your relationship with your current employer, your relationship to ALEC and its member legislators and corporations, and whether your firm's clients might be expecting preferential treatment should you be elected Attorney General. As citizens of Oregon, we demand that you disclose and clarify the following items: We call on you to disclose all financial and non-financial assistance which Lane Powell has provided to your campaign. By your campaign's own admission to the Portland Mercury, Lane Powell has provided you an office and other facilities (such as phones) at the firm's downtown location. To date, neither you nor your employer have reported this significant in-kind contribution to the Secretary of State's office. In fact, as reported by the Mercury, your campaign has stated that you don't intend to disclose this information until after the election. The citizens of Oregon deserve to know who contributes to your campaign before making their choice on the ballot. We call on you to provide an explanation of the circumstances around your employment at Lane Powell. On January 4th, you resigned from your job as U.S. Attorney. At the time, you 'declined to comment on any political plans'. On January 7th, you started a new job with Lane Powell's 'White Collar Criminal Defense' team. And just 4 days later, on January 11th, you announced your candidacy for Oregon Attorney General. The timing and circumstances raise some troubling questions: Did you discuss a run for Attorney General with representatives of Lane Powell or their clients while you were U.S. Attorney? Were the terms of your employment with Lane Powell in any way tied to a decision to run for Attorney General? Did Lane Powell offer employment and campaign support in exchange for preferential treatment for their clients if you're elected? Are Lane Powell's clients providing undisclosed campaign contributions, either financial or non-financial, through your compensation from the firm? What work have you done for the firm since you were hired? Given the nature of the work you are now doing at Lane Powell, the timing of your resignation as U.S. attorney, the subsequent hiring by Lane Powell, and the fact that Lane Powell is currently providing non-financial assistance to your campaign, all cast doubts on your ability to be an independent advocate for the people of Oregon. At best, it gives the appearance of a conflict of interest. At worst, it raises the specter of the largest corporations in America having influence on your decisions and expecting you to do their bidding. Your clients are a who's who of corporations that regularly face prosecution for mortgage fraud, price-fixing, pollution, health care fraud, tax fraud, government procurement fraud, money laundering, securities fraud, accounting fraud, deceptive practices, Ponzi schemes, off-shore banking fraud, and violating worker's rights As Attorney General, the people of Oregon would be counting on you to defend them from the formidable resources of these corporations. We need to know that you have not been bought and will do what's right for the people. Also disturbing is your firm's employment of Rep. Shawn Lindsay, who has taken vast amounts of campaign cash from out of state corporate interests in the past year. As you know, he is a legislative member of the American Legislative Exchange Council's Public Safety and Elections Task Force, which is responsible for providing model legislation like Florida's 'Stand Your Ground' law and various measures restricting voter access for minorities, seniors and students. In the Oregon legislature, Rep. Lindsay has sponsored many of ALEC's 'model bills'. ALEC's corporate membership includes many of your clients. Because of your firm's ties to ALEC, we ask that you disclose any ties, past or present, that you have to ALEC and its legislative and corporate members. We also ask that you publicly renounce ALEC and its legislative agenda, and pledge your support for efforts to subject it to the same regulations that apply to all other lobbying firms. Over the next few years, the Attorney General's office will be heavily involved in investigating and prosecuting mortgage and banking fraud, price-fixing, pollution and environmental destruction. Today, your job appears to be to DEFEND these corporate criminals. It's hard to believe that as Attorney General, you would switch to prosecuting them. Help us to understand how these appearances are not indicative of reality. You're a top lawyer for the 1%. We need to know why you think you can be the lawyer for the 99%.
