  1. Hi all,
  2.
  3. With a heavy heart I must inform you that Linux Learner has been banned from the mailing list.
  4.
  5. This is the first time that I can remember this happening on the list but we can no longer allow one person to continue to harass the list, its members or the admin team.
  6.
  7. In the interest of transparency, we have enabled moderator confirmation on new subscriptions to the mailing list.  This is a short term thing to just make sure LinuxLeaner does not re-subscribe and under a different address in an attempt to post to the list.  We hope that he accepts our decision and moves on.
  8.
  9. In dealing with LinuxLearner the admin team have also learnt a lot, from now on we will not use moderation in the long term, in fact we would rather never moderate anyone again!
  10. From now on the plan is simple....
  11.
  12. 1)  The list can moderate itself on a day to day basis, this does not mean that you flame others, but perhaps don't bite the low hanging fruit
  13. 2)  Admins step in with a polite message
  14. 3)  Admins step in with firm message if the polite is ignored
  15. 4)  Use moderation to prevent a thread from continuing to flame the list, either targeted at a user or subject.
  16. 5)  Ban
  17.
  18. We would like to never have to go above step 3, but this is up to everyone on the list.
  19.
  20. Now for the reason LinuxLearner has been banned.
  21.
  22. The following was received by the Surrey admin team today and is shown in full.  This is not the first time the admins have been attacked, lies were sent to the Hants list not more than a week ago but the admin team decided at the time not to rise to that bait,  and the issue was quickly closed on the Hants list by their list admin.
  23.
  24. What the Surrey admin team have to do with this matter is unknown to us, and a request directly to LinuxLearner as to the reason for the message (which we now understand) and why we have been involved is still unanswered.
  25.
  26. We have decided that no amount of moderation, assistance, guidance or support from us has moved us any further forward from where we were nearly a year ago when we first started having problems with LinuxLearner on the list.
  27.
  28. Now we understand that he is not responsible for all of the flames on the list and has in the past contributed a lot of useful information and discussion, but the fact remains that problems on the list often end up with him in the middle of it, either by choice or coincidence.
  29.
  30. As you can see from the message below (which may take a few read throughs to get the full understanding) this is an issue directly between LiunxLearner and another member of the list.  Why we have been involved is a matter that LL alone is aware of and the fact that he has taken to legal threats now makes him too dangerous to continue to be involved with for the admins liking.  It also shows that the apology posted to the list a week ago was mere lip service.
  31.
  32. If LinuxLeaner would like to come and explain his actions in person to the BaB on saturday we would be glad to hear from him and discuss this as I think the entire admin team will be there and available, anyone else if of course welcome to come talk to us.
  33.
  34. This is an open matter and comments on the list will not be closed, but please try and keep them constructive, comments shot from the hip with no thought serve no purpose or value to anyone and I am sure there are people with wildly differing opinions about this.  I hope you put the same time and effort into composing your reply as we have in writing this.
  35.
  36. Thanks
  37.
  38. Surrey Linux Admin Team

  130.
  131. FOR YOUR INFORMATION
  132.
  133. Nominet have confirmed they have started formal proceedings relating to
  134. the abusive registration of an org.uk domain on two grounds, registered
  135. to an address which no doubt your Red Hat employee records will show is
  136. also the address at which said Jon Fautley currently resides (unless of
  137. course said Jon Fautley also supplied a false address, as well as
  138. registrant details, at the time of registration, which I doubt, as he
  139. has other domains in his current name, also registered to this address).
  140.
  141. I copy next the email received. sent by Nominet to my solicitor (also
  142. kindly copied to me upon my request), which I verily believe confirms my
  143. suspicions that the individual who has set out to at the very least
  144. deliberately harass me by way of defamation in contravention of criminal
  145. law*, since at the very latest the 12th September 2009, ON A CONTINUED
  146. AND AT THE TIME OF WRITING, CONTINUING BASIS, is the said Jon Fautley,
  147. and thus a Red Hat employee. Furthermore, a crime was reported to Surrey
  148. Police on 2nd September 2009, for which I did not suspect said Jon
  149. Fautley, but now do.  I will be passing on that suspicion, in due
  150. course, and verily believe at the time of writing, that he may be
  151. arrested and processed by Surrey Police to obtain his DNA, fingerprints,
  152. etc, in furtherance of their continuing investigation into that matter,
  153. as evidence seized at the time of that suspected criminal offence was
  154. collected at sent off to the Serious and Organised Crime Agency**.

  173. him verbally this afternoon. I have also started processes based on our
  174. terms and conditions which will make this information public within 5
  175. days. The registrant name is also incorrect as it is not registered to a
  176. legally identifiable entity, which is another requirement, so I have
  177. contacted the registrant to request this is also updated.

  200.
  201. FOR THE INFORMATION of Red Hat, the email below should already be with

  205. Apologies for any confusion this has created for you - my email client

  253. Dear Sir or Madam,
  254.
  255. I write to request you urgently supply me by return of email with:
  256.
  257. 1.  full contact details for your legal department that deals with legal
  258. matters in the UK, including telephone number, fax number, email
  259. address(es), and postal address;
  260.
  261. 2.  full contact details (as above) for any human resources department
  262. which you have dealing with employees in the UK;
  263.
  264. 3.  the registered office details of any and all Red Hat group companies
  265. with the same, in England or Wales (i.e. the address Red Hat receives
  266. service of legal process at within the jurisdiction of England or
  267. Wales).  I have attempted to obtain this via companies house but the
  268. database gives me a slightly confusing answer.  Alternatively,
  269. confirmation by return of email, that this is said address and company
  270. which employs employees working at your Farnborough campus:
  271.
  272. RED HAT UK LIMITED
  273. AMBERLEY PLACE
  274. 107-111 PEASCOD STREET
  275. WINDSOR
  276. BERKSHIRE
  277. SL4 1TE
  278. Company No. 03798903
  279.
  280. I have just attempted to obtain all of the above via telephone call to
  281. the telephone number published on your website for your Farnborough
  282. Campus but was put through to an answering machine; no message was left.
  283.
  284. Please treat this matter as highly urgent - court action may be required
  285. today, and Red Hat may need to be enjoined as a party to those
  286. proceedings, on the basis of vicarious liability for the suspected
  287. criminal and civil actionable actions of one of it's employees, possibly
  288. undertaken during office hours and also possibly undertaken using Red
  289. Hat company resources.
  290.
  291. 1. and 2. above I require now, as I may wish to attempt to avoid this.
  292.
  293. For your information:  I am awaiting written confirmation from a
  294. solicitor acting on my behalf, of the identity of the suspected
  295. offender/wrongdoer, after the same is received, hopefully in the next
  296. few hours, from Nominet to that solicitor, who is to pass on such
  297. information to me, as soon as it is received.
  298.
  299. Please give this matter your most urgent attention.
  300.
  301. Sincerely,
  302.
  303. J Featherstone, LLB(HONS), barrister-at-law
  304.
  305. - ------------------------------------------------[End Copy Email]
  306.
  307. No doubt all in receipt of this message can now understand the
  308. seriousness of what has been happening and what is STILL A CONTINUING
  309. EVENT - damages no doubt accruing hourly - but a WHOIS on the following
  310. domains confirm I verily believe, that have the identity of the offender
  311. correct, beyond a reasonable doubt:
  312.
  313. 1.  virtualchambers.org.uk (defamatory/harassing see attached)
  314. 2.  peloris.co.uk (name server used for the above website)
  315. 3.  dead.li (confirmation, when output seen with the above).
  316.
  317. I once again urge Red Hat to respond to my earlier email.  If not, I
  318. will take decisions that all of us will have to live with, as your
  319. employee is continuing what I verily believe is his criminal harassment
  320. as I write, perhaps using your computing resources, or managing his own,
  321. from your premises, and on your time, and with a laptop or desktop and
  322. computer connection provided to him, by your organisation.
  323.
  324. Sincerely,
  325.
