WXY V Gewanter & Ors

Representatives of WXY (Archerfield Partners): "Since we were last before court the landscape has changed very greatly. There has been a great deal of reporting about this case."

"There is a pressing need for judgement to be handed down at the earliest possible opportunity. [CLIENT] has an understandable fear that her name may be published in the near future."

Raised concern over what Mr Burby may do with a draft judgement.

Justice Slade: "I wouldn't say the horse has bolted but the situation has changed."
[Responding to suggestion that client has yet to be named in national press]: "Unfortunately people do have access to the blogosphere."

Representatives of WXY ask for draft judgement to be circulated by 4pm that afternoon. Parliamentary committee due to meet on Monday and representatives hope that a judgement early next week would cause the committee to wait and consider final judgement.

Orders made on 17 January and 3 February to be set aside and case will now follow standard procedures. Previous judgements could only be viewed by Mr Burby in presence of a solicitor and he could not take copies. Now will be given on a confidential but unsupervised basis - he would be in contempt of court if this confidentiality was breached.
