  7. VISTO: La carpeta fiscal y revisada que fue la misma y CONSIDERANDO:

  9. PRIMERO.- Que, la persona de Ronald Vergara Garcia, formulo denuncia en via de prevencion en la Fiscalia de Prevencion del Delito contra Angel Manuel Pazos Peralta -- Director del Centro de Rehabilitacion "Los Amigos de Jesus", por los constantes abusos y maltratos que reciben los internos de dicho centro de rehabilitacion.

  11. SEGUNDO.- Que, el denunciante manifiesta que los abusos cometidos a los internos del mencionado lugar consistian en:

  13. - Hecharles agua fria durante toda la madrugada completamente desnudos y en pie con las manos atadas hacia atras y en momento de meditacion (castigo conocido como Hombre Noche).

  15. - Ponerse en rodillas colocandoles piedras en cada una de ellas (momento de meditacion).
  16.  
  17. - Hecerles ingerir bolos de sal con agua lo que les provocaba nauseas y/o vomitos.
  18.  
  19. - Hecharles orinas en el cuerpo produciendoles hongos en differentes partes del mismo.
  20.  
  21. - Ejercicios fisicos excesivos con repeticiones de cien veces cada ejercicio provocandoles presuntamente hernias y calambres en sus extremidades.

  23. - Gritos en los oidos de manera fuerte entre los internos.
  24.  
  25. - Hecharles agua de cocha (agua sucia recogida despues de trapear pisos).

TERCERO.- Que, ante tal hecho este Despacho Fiscal programo un operativo inopinado en las instalaciones del Centro de Rehabilitacion "Los Amigos de Jesus", pudiendo constatar IN SITU que los internos viven asilados en un ambiente pequeño donde realizan todas sus actividades de la semana, siendo pues que en dicho lugar el RMP se entrevisto con la mayoria de los internos quienes conincidieron en sus versiones al señalar que son maltratados tanto fisicamente como psicologicamente siendo las ordenes dadas por el mismo Director, las cuales son cumplidas por los Hermanos Mayores que vienen hacer los internos con mas tiempo en el centro dejandose constancia de todas las incidencias en el Acta de Verificacion y Constatacion obrante de fojas once a dieciseis de la presente carpeta fiscal.

CUARTO.- Que, en la entrevista sostenida con cada uno de los internos estos representaban la forma como son castigados realizandose para ello tomas fotograficas las mismas que obran de fojas dieciocho a veintidos de la presente carpeta fiscal, del mismo modo mostraron las marcas de las heridas producidas aparentemente en dicho centro de rehabilitacion producto de los constantes maltratos del que son victimas realizandose para ello tomas fotograficas las mismas que obran de fojas veintitres a treinta de la presente carpeta fiscal, y por ultimo representaron en un ambiente del mismo centro rehabilitacion la forma como meditan con las manos detras del cuerpo por periodos prolongados, realizandose para ello tambien tomas fotograficas las mismas que obran de fojas treintiuno a treintidos de la presente carpeta fiscal. Asi mismo a fojas diecisiete de la presente carpeta fiscal obra las Reglas y Correctivos del Departamento de Piso impuesto a los mismos internos que infrijan dichas normas.

QUINTO.- Que, de todo lo expuesto por los internos y verificar los maltratos fisicos del que son objeto es necesario que pasen un reconocimiento medico legal en el Instituto de Medicina Legal del Ministerio Publico a fin de descartar cualquier tipo de lesiones o complicaciones que pudiesen perjudicar su salud, del mismo modo en dicho operativo se conto con la participacion de los representantes del area de Seguridad Ciudadana y Fiscalizacion de la Municipalidad Provincial de San Martin quien al solicitar la documentacion respectiva al Director del centro de rehabilitacion esta manifesto que no contaba con Licencia de Funcionamiento, Certificado de Defensa Civil, Constancia de Fumigacion, etc., por lo que dicho personal procedio a dejarle una notificacion preliminar dandole un plazo de cinco dias habiles para que regularice toda su documentacion caso contrario seria objeto a la multa respectiva. Con relacion a la higiene de los ambientes del mencionada centro de rehabilitacion, personal municipal en mencion procedio a aplicar una multa de mil ochente nuevos soles (S/ 1080), por no reunir las garantias del caso.

SEXTO.- Que, con la finalidad de esclarecer los hechos en el presente caso es necesario recabar las declaraciones indagatorias en via de prevencion a las peronas involucradas fijandose por tal motivo fecha y hora para la toma de las mismas no sin antes dejar constancia que el plazo de la investigacion esta por vencer y faltando aun diligencias por actuar es necesario ampliar la investigacion en un plazo prudencial de conformidad con lo señalado en el nuevo Codigo Procesal Penal que en el articulo 334 inciso 2 refiere: "...No obstante el Fiscal podra fijar un plazo distinto segun las caracteristicas, complejidad y circunstancias de los hechos objeto de investigacion...".

SETIMO.- Que, la Resolucion de la Comision Ejectuva del Ministerio Publico No 539-99-MP-CEMP -- Reglamento de Organizacion y Funciones de las Fiscalias Especiales de Prevencion del Delito en su Articulo 8 refrido a las Atribuciones del Fiscal Provincial de Prevencion del Delito inciso b) señala: "Ejecutar acciones preventivas del delito e intervenir en las denuncias interpuestas por personas naturals y/o juridicas, instituciones publicas y/o privadas, las difundidas por los medios de comunicacion y de oficio, alusivas a las materias de prevencion del delito, supervigilando el cumplimiento de las disposiciones legales".

OCTAVO.- Que, de conformidad con el articulo 10 de las Resolucion No 539-99-MP-CEMP, Reglamento de Organizacion y Funciones de las Fiscalias Especiales de Prevencion del Delito, las denuncias y solicitudes de intervencion preventiva se atienden cuando el interes publico o el bien juridico tutelado por el derecho se halia manifestamente amenazado y siendo esto asi SE RESUELVE: AMPLIAR LA INVESTIGACION PREVENTIVA POR UN PLAZO DE TREINTA DIAS HABILES, asi mismo PROGRAMESE la declaracion indagatoria en via de prevencion del denunciado Angel Manuel Pazos Peralta domiciliado en el Jr. Camila Morey No 624 -- Tarapoto, para el dia SIETE DE SETIEMBRE a las NUEVE DE LA MAÑANA, quien debera concurrir accompañado de un Abogado defensor de su libre eleccion de conformidad con lo señalado por el nuevo Codigo Procesal Penal, RECABESE las declaraciones indagatorias en via de prevencion de los presuntos agraviados que se encuentran internados en el Centro de Rehabilitacion en mencion siedo estos los siguientes:

OFICIESE al Instituto de Medicina Legal para que con su personal especializado realice las evaluaciones respectivas en las instalaciones de dicho Instituto de los internos del centro de rehabilitacion para descartar cualquier tipo de emfermedad siendo para ello necesario que el Director del Centro de Rehabilitacion "Los Amigos de jesus" autorice que los internos del mismo acudan a las instalaciones del Instituto de Medicina Legal, REPROGRAMESE una DIligencia de Inspeccion al centro de rehabilitacion estando el dia y la hora aun por definir, SOLICITESE Informe detallado al area de Seguridad Ciudadana y Fiscalizacion de la Municipalidad Provincial de San Martin indicando si el denunciado cumplio con las observaciones encontradas. Las declaraciones se llevaran a cabo en las instalaciones de la Fiscalia de Prevencion del Delito cito para tal efecto el Jr. Grau No 701 de ña coidad de Tarapoto. Notifiquese conforme a ley-
